【摘要】：第一部分闡述了研究濫用職權(quán)罪的“重大損失”的現(xiàn)實意義和理論意義，分析了濫用職權(quán)罪的“重大損失”的研究現(xiàn)狀。 第二部分論述了濫用職權(quán)罪的“重大損失”的范圍。無論是從現(xiàn)行刑法條文和司法解釋的規(guī)定來看，還是從應(yīng)然層面分析，非物質(zhì)性損失和間接經(jīng)濟(jì)損失都屬于濫用職權(quán)罪的“重大損失”。對新頒布的司法解釋中關(guān)于濫用職權(quán)罪的“重大損失”的范圍所出現(xiàn)的一些新變化進(jìn)行了解析。對直接經(jīng)濟(jì)損失和間接經(jīng)濟(jì)損失進(jìn)行了重新定義。從應(yīng)然的層面思考，歸納了非物質(zhì)損失應(yīng)該包括的幾個主要類型。 第三部分論述了濫用職權(quán)罪的“重大損失”的認(rèn)定。通過對學(xué)術(shù)界和實務(wù)界存在的不同觀點進(jìn)行梳理和分析，得出了應(yīng)當(dāng)以濫用職權(quán)犯罪成立之日作為認(rèn)定經(jīng)濟(jì)損失的計算時間的結(jié)論。從應(yīng)然的層面分析，濫用職權(quán)罪的不同損失可以混合。損失是否可以累計不可一概而論，應(yīng)當(dāng)具體問題具體分析，當(dāng)濫用職權(quán)行為造成的損失類型屬于人員傷亡類和財產(chǎn)損失類時，，損失可以累計。對“惡劣社會影響”的司法認(rèn)定、為本單位利益而濫用職權(quán)如何處理等司法實踐中存在的疑難問題進(jìn)行了探討。 第四部分對本文的主要觀點進(jìn)行了歸納總結(jié)。
[Abstract]:The first part expounds the practical and theoretical significance of the study on the crime of abusing power, and analyzes the present situation of the research on the crime of abusing power.The second part discusses the scope of the crime of abuse of power.No matter from the provisions of the current criminal law and judicial interpretation, or from the perspective of the ought to be, the non-material loss and indirect economic loss are all "significant losses" of the crime of abuse of power.This paper analyzes some new changes in the scope of "heavy loss" of the crime of abuse of power in the newly promulgated judicial interpretation.The direct economic loss and indirect economic loss are redefined.In this paper, several main types of non-material loss are summarized.The third part discusses the cognizance of the crime of abuse of power.By combing and analyzing the different viewpoints of academic and practical circles, this paper draws a conclusion that the date of the crime of abuse of power should be taken as the calculating time to determine the economic loss.From the perspective of the ought to be, the different losses of the crime of abuse of power can be mixed.Whether the loss can be accumulated can not be generalized, it should be analyzed concretely. When the loss type caused by abuse of power belongs to the category of casualties and property losses, the loss can be accumulated.This paper probes into the problems existing in judicial practice, such as judicial cognizance of "bad social impact" and how to deal with the abuse of power for the benefit of the unit.The fourth part summarizes the main viewpoints of this paper.
