【摘要】：互聯(lián)網(wǎng)是一把雙刃劍,能夠幫助人們迅速而高效地獲取各種信息,但互聯(lián)網(wǎng)中也包含著大量的色情信息。我國互聯(lián)網(wǎng)正進(jìn)入飛速發(fā)展的階段,網(wǎng)民數(shù)量急劇增長,尤以青少年形成主力軍。為了遏制色情信息的蔓延,維護(hù)文明健康的秩序,保護(hù)未成年人的合法權(quán)益,各國開始對網(wǎng)絡(luò)色情信息進(jìn)行行政管制。本文正是在這種背景下,針對我國目前網(wǎng)絡(luò)色情信息行政管制剛剛起步,面臨諸多的不足和困境,分析和探討網(wǎng)絡(luò)色情信息行政管制的完善建議,旨在為建立網(wǎng)絡(luò)色情信息行政管制的理論提供借鑒意義。 本文從四個部分來討論了我國網(wǎng)絡(luò)色情信息的行政管制： 第一部分為引言。主要分析了選題的背景及意義、國內(nèi)外的研究現(xiàn)狀以及本文的創(chuàng)新點(diǎn)。從我國互聯(lián)網(wǎng)發(fā)展背景出發(fā),得出了對我國網(wǎng)絡(luò)色情信息進(jìn)行行政管制很有必要的結(jié)論,這不僅是對國外行政管制的經(jīng)驗(yàn)總結(jié),也是符合我國國情的需要。除此之外,相較于其他管制手段,行政管制具有天然的優(yōu)勢,行政管制具有時代特征,更能應(yīng)對和解決互聯(lián)網(wǎng)發(fā)展中出現(xiàn)的新問題,而且行政管制具有強(qiáng)制力強(qiáng)且效率也更高。 第二部是網(wǎng)絡(luò)色情信息行政管制的概述。在這一部分要明確網(wǎng)絡(luò)色情信息行政管制的界定,首先要了解何為網(wǎng)絡(luò)色情信息及何為行政管制,從而得出網(wǎng)絡(luò)色情信息行政管制的概念及其特點(diǎn)。 第三部分是網(wǎng)絡(luò)色情信息行政管制必要性的理論分析。雖然網(wǎng)絡(luò)色情信息屬于表達(dá)自由的范疇,我國憲法也保護(hù)公民的言論自由,但憲法同時規(guī)定,公民在行使言論自由的同時不得損害國家的、集體的、社會的及其他公民的權(quán)利和自由。通過辨證地分析表達(dá)自由與行政管制之間的關(guān)系,得出我國有必要對網(wǎng)絡(luò)色情信息加以管制的結(jié)論。 第四部分是網(wǎng)絡(luò)色情信息行政管制存在的問題分析。從分析我國網(wǎng)絡(luò)色情信息泛濫的現(xiàn)狀及原因出發(fā),探討我國目前對網(wǎng)絡(luò)色情信息行政管制現(xiàn)狀中存在的不足之處,主要內(nèi)容包括立法、執(zhí)法、輔助行政管制的社會組織的現(xiàn)狀、行政管制的技術(shù)監(jiān)管的不足。 第五部分是提出我國網(wǎng)絡(luò)色情信息行政管制的完善建議。根據(jù)我國網(wǎng)絡(luò)色情信息行政管制中存在的問題,提出適合我國國情的網(wǎng)絡(luò)色情信息行政管制的完善建議。該部分主要可以分為兩大部分,一是完善的原則,二是完善的具體建議。
[Abstract]:The Internet is a double-edged sword, which can help people to obtain all kinds of information quickly and efficiently, but the Internet also contains a lot of pornographic information.China's Internet is entering the stage of rapid development, the number of Internet users has increased dramatically, especially young people form the main force.In order to curb the spread of pornographic information, maintain the order of civilization and health, protect the legitimate rights and interests of minors, countries began to carry out administrative control over pornographic information on the Internet.Under this background, aiming at the fact that the administrative regulation of network pornographic information in our country is just in its infancy and facing many shortcomings and difficulties, this paper analyzes and probes into the perfect suggestions of the administrative regulation of network pornographic information.The purpose of this paper is to provide reference for the establishment of network pornographic information administrative control theory.This paper discusses the administrative regulation of pornographic information on the Internet in China from four parts:The first part is the introduction.This paper mainly analyzes the background and significance of the topic, the domestic and foreign research situation and the innovation of this paper.Based on the background of the development of internet in our country, this paper draws a conclusion that it is necessary to regulate the network pornographic information in our country, which is not only a summary of the experience of administrative control in foreign countries, but also meets the needs of the national conditions of our country.In addition, compared with other regulatory means, administrative control has natural advantages, administrative control has the characteristics of the times, more able to deal with and solve the new problems in the development of the Internet, and administrative control has a strong coercive force and higher efficiency.The second part is an overview of the network pornographic information administrative control.In this part, it is necessary to define the administrative regulation of network pornographic information, first of all, to understand what is network pornographic information and what is administrative control, and then to obtain the concept and characteristics of administrative control of network pornographic information.The third part is the theoretical analysis of the necessity of network pornographic information administrative regulation.Although pornographic information on the Internet belongs to the category of freedom of expression and the Constitution of our country also protects the freedom of speech of citizens, it also stipulates that citizens shall not, while exercising freedom of expression, harm the state and the collective.The rights and freedoms of society and other citizens.Through dialectical analysis of the relationship between freedom of expression and administrative regulation, it is concluded that it is necessary to regulate the network pornographic information in our country.The fourth part is the analysis of the problems existing in the administrative control of network pornographic information.Based on the analysis of the present situation and reasons of the overflow of network pornographic information in our country, this paper probes into the shortcomings of the present administrative control of network pornographic information in our country. The main contents include legislation, law enforcement, and the current situation of social organizations supporting administrative control.The inadequacy of the technical supervision of administrative control.The fifth part is to put forward our country network pornographic information administrative control consummate suggestion.According to the problems existing in the administrative control of network pornographic information in our country, this paper puts forward some suggestions to perfect the administrative control of network pornographic information suitable for the national conditions of our country.This part can be divided into two parts, one is the principle of perfection, the other is the specific suggestions.
