【摘要】：刑法能力是刑法倫理、刑法品格、刑法質(zhì)量、刑法環(huán)境、刑法方法、刑法效能的綜合反映,是指刑法在生成、運(yùn)行中所發(fā)揮的能量,包括內(nèi)在能力和外在能力。其中前者可分解為刑法的規(guī)范能力、刑法的宣示能力、刑法的自我調(diào)節(jié)能力;后者主要有刑法的標(biāo)識能力、刑法的普及能力、刑法的協(xié)調(diào)與應(yīng)變能力、刑法的重構(gòu)與整合能力、刑法的適用能力等。能夠體現(xiàn)刑法規(guī)范生命力和時代感的是刑法的創(chuàng)新能力,包括刑法的科學(xué)化能力、刑法的理念革新能力、刑法的體系調(diào)整能力。刑法能力理念強(qiáng)調(diào)刑法積極參與社會管理的實(shí)踐性、能動性和創(chuàng)新性。刑法生成能力、刑法運(yùn)行能力和刑法創(chuàng)新能力構(gòu)筑了刑法能力體系的主體部分。
[Abstract]:Criminal law capacity is the comprehensive reflection of criminal law ethics, criminal law character, criminal law quality, criminal law environment, criminal law method and criminal law efficiency.The former can be divided into the normative capacity of criminal law, the ability of declaring criminal law, the ability of self-adjustment of criminal law, the ability of marking criminal law, the capacity of popularization of criminal law, the ability of coordination and contingency of criminal law, the ability of reconstruction and integration of criminal law, the latter has the ability of marking criminal law, popularizing criminal law, coordinating and adapting criminalThe applicable capacity of criminal law, etc.What can embody the vitality of the criminal law and the sense of the times is the innovative ability of the criminal law, including the scientific ability of the criminal law, the ability of the innovation of the concept of the criminal law, and the ability of adjusting the system of the criminal law.The concept of criminal law capacity emphasizes the practicality, initiative and innovation of criminal law actively participating in social management.The main body part of the criminal law capacity system is the criminal law generating ability, the criminal law operation ability and the criminal law innovation ability.
