【摘要】：網(wǎng)絡(luò)犯罪的形式評價(jià)應(yīng)該嚴(yán)格遵循罪刑法定原則,網(wǎng)絡(luò)犯罪的特殊性使得對其進(jìn)行形式評價(jià)的過程中出現(xiàn)了解釋上的困境。在運(yùn)用傳統(tǒng)刑法解釋方法的同時(shí),充分考慮網(wǎng)絡(luò)犯罪行為的方式、對象、地點(diǎn)和情節(jié)等與線下行為的等置性問題,將有利于對網(wǎng)絡(luò)犯罪作出較為恰當(dāng)?shù)脑u價(jià)。等置性的評價(jià)標(biāo)準(zhǔn)是網(wǎng)絡(luò)犯罪形式評價(jià)的有效手段,將這一思維方式貫穿于構(gòu)成要件符合性、違法性和有責(zé)性的判斷過程,可以在網(wǎng)絡(luò)犯罪領(lǐng)域更加精確地解釋和適用刑法。
[Abstract]:The formal evaluation of network crime should strictly follow the principle of legally prescribed punishment for a crime. The particularity of network crime makes it difficult to interpret in the process of formal evaluation. It will be beneficial to make a more appropriate evaluation of the network crime by fully considering the way, object, place and plot of the network crime and the problem of the equiposition of the offline behavior, which is an effective means for the evaluation of the form of the network crime. This way of thinking runs through the judgment process of conformance, illegality and responsibility of constitutive elements, which can explain and apply criminal law more accurately in the field of cybercrime.
