【摘要】：關(guān)于偶然防衛(wèi),學術(shù)界存在行為無價值論與結(jié)果無價值論之間的爭論,各有優(yōu)缺,但是從犯罪預防的角度來看,行為無價值理論與結(jié)果無價值理論本身存在無法彌補的漏洞,對偶然防衛(wèi)應(yīng)該堅持從刑法意義上"行為"的角度出發(fā)對偶然防衛(wèi)進行定性。
[Abstract]:As for accidental defense, there are arguments between the theory of behavior non-value and the theory of result non-value in academic circles, each has its own advantages and disadvantages, but from the point of view of crime prevention, the theory of behavior without value and the theory of result without value itself have irreparable loopholes. To the accidental defense, we should insist on the qualitative analysis of the accidental defense from the angle of criminal law meaning "behavior".
