【摘要】：猥褻性犯罪作為一類淫穢、下流犯罪行為,此類行為破壞的不的僅僅是良好的社會風(fēng)氣、社會道德,同時也因為行為的特殊性、淫穢性在某種程度上也嚴(yán)重侵犯了他人的性權(quán)利、性道德,具有極壞的社會影響。針對此類行為,我國1997年《刑法》在原有法律的基礎(chǔ)上取消了流氓罪,并且將流氓罪規(guī)制的一些列犯罪行為單獨(dú)成罪,其中就包括了強(qiáng)制猥褻罪。猥褻行為的獨(dú)立成罪,為保護(hù)公民人身權(quán)利特別是婦女、兒童的行自主決定權(quán)方面提供了更加有利的法律依據(jù)和執(zhí)法保障,并且在很長一段時間內(nèi)為當(dāng)時維護(hù)社會秩序起到了極大的作用,但是在1997年《刑法》中還存在著種種問題,亟待我們解決。《刑法修正案(九)》的頒布填補(bǔ)了1997年《刑法》的某些立法方面的漏洞,使得男女兩性的性自主決定權(quán)得以全面受到保護(hù),這是當(dāng)今法律進(jìn)一步發(fā)展所催生的結(jié)果,也是人們自我保護(hù)意識提高的體現(xiàn)。此后,針對受害者為成年男性的案件,法院在進(jìn)行性質(zhì)認(rèn)定、罪名適用方面可直接使用關(guān)于該修正案的法規(guī),而不必再像過去考慮加害方是否存在故意或造成被害人傷亡等其他因素,進(jìn)一步實(shí)現(xiàn)了于法有據(jù)、有法可依,也是對人權(quán)保護(hù)的體現(xiàn),具有重要的現(xiàn)實(shí)意義。在立法進(jìn)一步完善的背景下,針對此類行為如何對其進(jìn)行定性中以及針對具體案件進(jìn)行定罪量刑等方面更需要貼合立法現(xiàn)狀。在司法實(shí)務(wù)中也存在著諸如實(shí)務(wù)不熨帖、脫節(jié)等問題,這些也是需要司法工作人員在具體案件辦理過程中來進(jìn)一步解決的,本文將針對此類問題展開進(jìn)一步的論述。
[Abstract]:Indecent sex crimes, as a kind of obscene and obscene crimes, do not only destroy the good social atmosphere and social morality, but also because of the particularity of the behavior. Obscenity, to a certain extent, also seriously infringes upon the sexual rights and morals of others, and has a very bad social impact. In response to this kind of behavior, in 1997, the Criminal Law of our country abolished the crime of hooliganism on the basis of the original laws. And the hooliganism regulation of a number of individual criminal acts, including the crime of forced indecency, the crime of indecent assault, in order to protect the personal rights of citizens, especially women, The children's decision-making power provided a more favorable legal basis and law enforcement protection, and played a great role in maintaining social order at that time for a long time. But in 1997, there were still many problems in the Criminal Law. The promulgation of the Amendment (IX) to the Criminal Law filled some legislative gaps in the Criminal Law in 1997, enabling both men and women to fully protect their sexual autonomy. This is the result of the further development of today's law, and a reflection of the increased awareness of self-protection. Since then, in cases where the victim is an adult male, the court has held by nature, The law on the amendment can be directly used in the application of the offence, without having to consider, as in the past, whether there are other factors, such as whether the perpetrator intentionally or caused the victim's injury or injury, thus further realizing that there is evidence in the law and that there is a law to be followed. It is also a reflection of the protection of human rights, which is of great practical significance. In view of how this kind of behavior can be characterized as well as the conviction and sentencing of specific cases, it is more necessary to match the current situation of legislation. In judicial practice, there are also problems such as not ironing and disjointing in practice, and so on. These also need to be further solved by judicial staff in the process of handling specific cases, this paper will further discuss this kind of problems.
