【摘要】：互聯(lián)網(wǎng)市場得益于信息技術(shù)的高速發(fā)展已呈成熟健全之勢,在這股勢頭的影響下,網(wǎng)絡(luò)游戲產(chǎn)業(yè)隨著這股浪潮席卷全球,儼然成為該領(lǐng)域最具影響力的經(jīng)濟產(chǎn)業(yè)。網(wǎng)絡(luò)游戲產(chǎn)業(yè)的興盛,衍生出了虛擬財產(chǎn)這一新興概念。虛擬財產(chǎn)具有多樣化的類型,交易平臺廣泛,隨著其影響力的提升,與之相關(guān)的侵害事件也不斷高漲,其中涉及最多的莫過于盜竊、詐騙等與互聯(lián)網(wǎng)絡(luò)中虛擬貨幣、賬號密碼相關(guān)的危害行為。虛擬財產(chǎn)脫胎于互聯(lián)網(wǎng)絡(luò)的娛樂活動,尤其在網(wǎng)絡(luò)游戲中廣泛存在,經(jīng)過分析可以看出其與傳統(tǒng)意義上的財產(chǎn)相類似,與無形財產(chǎn)有著包含與被包含的關(guān)系。虛擬財產(chǎn)本身具有財產(chǎn)性,擁有一般定性財產(chǎn)時所需要具備的效用性、稀缺性、可控性和排他性。盡管各界關(guān)于虛擬財產(chǎn)的爭論還未平息,紛雜的學理分歧不見定論,但不可否認的是,虛擬財產(chǎn)應當受到法律的約束與保護。目前,世界各國都對網(wǎng)絡(luò)虛擬財產(chǎn)的刑法保護提出了相應的規(guī)制措施,但在我國對網(wǎng)絡(luò)虛擬財產(chǎn)的刑法保護爭議尚存,虛擬財產(chǎn)的認定方法雖然多樣,但尚未得到完全的統(tǒng)一。針對我國目前出現(xiàn)的相關(guān)立法和司法解釋缺失所造成的刑法介入標準模糊、虛擬財產(chǎn)認定方法混亂等問題,我們應當從完善相關(guān)立法和司法解釋入手,逐步制定相應的刑法修正案和單行刑法,通過實踐中對相關(guān)司法解釋的適度擴張,明晰虛擬財產(chǎn)案件刑法介入標準;從游戲玩家和游戲運營商的不同法益主體出發(fā),根據(jù)虛擬財產(chǎn)類型的差異,制定區(qū)別統(tǒng)一的虛擬財產(chǎn)數(shù)額認定方法,避免造成司法實務(wù)中定罪量刑畸重畸輕的情形,進一步推動我國網(wǎng)絡(luò)虛擬財產(chǎn)刑法保護的完善。
[Abstract]:The Internet market benefits from the rapid development of information technology. Under the influence of this momentum, the online game industry has swept the world with this tide. It has become the most influential economic industry in this field. The prosperity of online game industry has given rise to the new concept of virtual property. Virtual property has a variety of types, trading platform is extensive, with the increase of its influence, The related violations are also on the rise, involving nothing more than theft, fraud, and other harmful acts related to virtual currency and account passwords in the Internet. The virtual property is derived from Internet entertainment. Especially in the network game, the analysis shows that it is similar to the traditional property, and has the relationship between the intangible property and the intangible property. The utility, scarcity, controllability and exclusivity required to possess a generic property. Although the debate on virtual property has not been settled and the various theoretical differences are inconclusive, it is undeniable that, Virtual property should be restricted and protected by law. At present, every country in the world has put forward the corresponding regulation measures to the criminal law protection of network virtual property, but in our country the criminal law protection of network virtual property still exists. Although the identification method of virtual property is diverse, it has not been completely unified. In view of the ambiguity of criminal law intervention standard caused by the absence of relevant legislation and judicial interpretation, the confusion of the method of virtual property identification, etc. We should start with perfecting the relevant legislation and judicial interpretation, gradually formulate the corresponding criminal law amendment and single criminal law, through the appropriate expansion of the relevant judicial interpretation in practice, clear the criminal law intervention standard of virtual property cases; Starting from the different subjects of legal interests of the game players and the game operators, and according to the differences of the types of virtual property, the paper formulates a different and unified method of determining the amount of virtual property, so as to avoid the situation that the conviction and sentencing in judicial practice are abnormal and heavy. Further promote the improvement of the criminal law protection of network virtual property in our country.
