【摘要】：本文結(jié)合容留賣淫罪在司法實(shí)踐中的具體問題,比較中外立法,找出我國相關(guān)容留賣淫罪的立法中存在的一系列問題,進(jìn)而根據(jù)現(xiàn)行法律規(guī)定給出一系列完善建議,以期其更加合法合理且具可操作性地解決實(shí)踐中容留賣淫罪的問題。 首先,對(duì)賣淫罪進(jìn)行整體性描述。從罪的立法演變至容留賣淫罪的概念、以及此罪的犯罪構(gòu)成要件方面,進(jìn)行總體概述。 其次,對(duì)容留賣淫罪司法適用中存在的問題進(jìn)行分析。從實(shí)際案例的實(shí)案爭議考察、到通過對(duì)刑事政策與刑事基本原則、立法規(guī)定三方面進(jìn)行理論分析,全方面展示該罪存在的問題。針對(duì)容留賣淫罪此罪名本身,具體分析我國容留賣淫罪司法適用中存在的問題與諸多爭議。 最后,是基于罪責(zé)刑相適應(yīng)的刑法基本原則和寬嚴(yán)相濟(jì)刑事政策以及法律需適應(yīng)當(dāng)今社會(huì)現(xiàn)實(shí)的基本思路,從解決容留賣淫罪疑難問題的角度,分別從刑法立法、司法解釋層面對(duì)容留賣淫罪的完善提出一些建議。
[Abstract]:Combined with the specific problems of the crime of sheltering prostitution in judicial practice, this paper compares the domestic and foreign legislation, finds out a series of problems existing in the legislation of the crime of sheltering prostitution in our country, and then puts forward a series of perfect suggestions according to the current legal provisions. In order to solve the problem of the crime of prostitution in practice more legally, reasonably and operationally. First of all, the whole description of the crime of prostitution, from the legislative evolution of the crime to the concept of the crime of accommodating prostitution, as well as the constituent elements of the crime, a general overview. Secondly, it analyzes the problems existing in the judicial application of the crime of accommodating prostitution. From the investigation of the actual case dispute in the actual case to the theoretical analysis of the criminal policy and the basic principles of criminal law, the legislation provides three aspects of theoretical analysis. Aiming at the crime of sheltering prostitution itself, this paper analyzes the problems and disputes in the judicial application of the crime of sheltering prostitution in China. Finally, based on the basic principles of criminal law, the criminal policy of combining leniency and severity, and the basic thinking that the law needs to adapt to the current social reality, and from the angle of solving the difficult problem of the crime of sheltering prostitution, the criminal law legislates separately from the point of view of settling the difficult problem of the crime of sheltering prostitution. At the level of judicial interpretation, some suggestions are put forward for the perfection of the crime of sheltering prostitution.
