【摘要】：反商業(yè)賄賂是推進(jìn)國民經(jīng)濟(jì)健康發(fā)展的重要環(huán)節(jié),能否有效控制商業(yè)賄賂的案發(fā)率,從而構(gòu)建健康和諧穩(wěn)定的社會氛圍是格外重要的。筆者選擇醫(yī)療行業(yè)這一商業(yè)賄賂的高發(fā)領(lǐng)域作為本文的切入點(diǎn),結(jié)合當(dāng)前互聯(lián)網(wǎng)大數(shù)據(jù)的背景,對于醫(yī)療行業(yè)內(nèi)的商業(yè)賄賂犯罪案例進(jìn)行數(shù)據(jù)上的分析,就目前可以檢索到的全部案例進(jìn)行歸類總結(jié),以犯罪學(xué)的研究視角,剖析醫(yī)療行業(yè)內(nèi)的商業(yè)賄賂行為。首先,在整個(gè)文章的導(dǎo)論部分著重提出問題并將這一提出的問題貫穿全文。針對目前商業(yè)賄賂行為的橫行肆虐,相反的群眾對其存在竟然逐漸麻木放縱,這一現(xiàn)狀應(yīng)當(dāng)足以引起社會的警惕,許多商業(yè)賄賂行為在日常生活中逐漸演變成了一類“潛規(guī)則”,得到社會無奈的接納甚至認(rèn)可,這無疑是非常危險(xiǎn)的境地,對行為人本身容易導(dǎo)致其逐漸走上犯罪的道路,對于整個(gè)社會也是不良風(fēng)氣的擴(kuò)散,因此關(guān)注商業(yè)賄賂的防治無疑是迫在眉睫的。筆者在收集案件數(shù)據(jù)的過程中,發(fā)現(xiàn)案發(fā)醫(yī)療行業(yè)的案件數(shù)目足足占到全部案件的半數(shù),因此醫(yī)療行業(yè)的商業(yè)賄賂行為防治工作應(yīng)當(dāng)作為重中之重。目前在學(xué)術(shù)界對于醫(yī)療行業(yè)內(nèi)商業(yè)賄賂犯罪的研究并未占據(jù)主流,有部分學(xué)者提出了自己的防治觀點(diǎn),與此同時(shí)國際上也有部分反商業(yè)賄賂的先進(jìn)經(jīng)驗(yàn)值得我國學(xué)習(xí)。本文的研究思路主要是借助當(dāng)前大數(shù)據(jù)的背景,收集、整理案例中的信息,并根據(jù)信息得出相關(guān)犯罪的特征框架,并根據(jù)現(xiàn)有的信息歸納總結(jié)出商業(yè)賄賂行為的防治體系,文章遵循提出問題——分析問題——解決問題的思路,采用犯罪學(xué)最基礎(chǔ)的研究體系,每個(gè)部分都給予一定筆墨充分論述,最終得出飽滿的結(jié)論。接下來,在商業(yè)賄賂犯罪的現(xiàn)象論部分集中列舉收集到的數(shù)據(jù),以圖表的形式清晰的呈現(xiàn)各個(gè)特征,其中著重強(qiáng)調(diào)醫(yī)療行業(yè)商業(yè)賄賂犯罪的高發(fā)性,并關(guān)注定罪、量刑兩部分應(yīng)當(dāng)關(guān)注的問題,商業(yè)賄賂現(xiàn)在并沒有作為單獨(dú)的罪名出現(xiàn)在我國的刑法典中,因此應(yīng)當(dāng)關(guān)注每類行為的入罪方式,并關(guān)注何種因素會影響入罪,是否存在爭議等問題,在量刑部分重點(diǎn)關(guān)注影響量刑的情節(jié)是否廣泛存在,整體的處罰傾向如何等問題。對數(shù)據(jù)歸納結(jié)束后,現(xiàn)象論中還包括論述目前醫(yī)療行業(yè)中商業(yè)賄賂的存在形式與商業(yè)賄賂的危害性。在這一部分著重呈現(xiàn)商業(yè)賄賂的多樣性、隱蔽性以及對于整個(gè)社會以及每一位社會成員都具有極其惡劣的影響。醫(yī)療行業(yè)商業(yè)賄賂犯罪的原因論作為本文的重點(diǎn)章節(jié)之一,從犯罪原因的概述、社會原因、文化原因、心理原因等四個(gè)方面出發(fā),全面的論述了該類行為發(fā)生的原因,其中社會原因中囊括了政府投入不足等政治性原因,同時(shí)醫(yī)療行業(yè)基于特殊的歷史背景形成了“以醫(yī)養(yǎng)藥”的行業(yè)模式,醫(yī)療機(jī)構(gòu)內(nèi)部也存在類似的誕生于特定歷史時(shí)期的體制性因素,都造成了商業(yè)賄賂多發(fā)的現(xiàn)狀,中國也自古以來就是人情社會,商業(yè)賄賂逐漸作為社會中暗藏的潛規(guī)則而存在。醫(yī)生群體作為投入大、收入少的低性價(jià)比行業(yè),心理上難免失衡。在多種因素的共同作用下,自然形成當(dāng)前局面。最后一部分是醫(yī)療行業(yè)商業(yè)賄賂犯罪的防治論,這一部分同樣是本文的重點(diǎn)章節(jié)。該部分針對商業(yè)賄賂高發(fā)的原因,因地制宜的提出了一系列防治措施,其中包括制度性預(yù)防、社會預(yù)防、體制性預(yù)防、心理預(yù)防等方面。從不同的角度出發(fā)闡述相應(yīng)的預(yù)防方法,從而達(dá)到犯罪預(yù)防的目的。
[Abstract]:Anti commercial bribery is an important part for promoting the healthy development of the national economy, can effectively control the commercial bribery crime rate, in order to build a healthy and harmonious and stable social atmosphere is very important. The author chooses the medical industry of commercial bribery in field as the breakthrough point, combined with the current Internet data analysis data on the background.
