【摘要】：減刑制度是刑事執(zhí)行制度的重要組成部分，減刑制度在穩(wěn)定監(jiān)獄監(jiān)管秩序、鼓勵(lì)服刑人員改過自新重新回歸社會(huì)方面起到了重要作用。但在減刑的適用過程中還存在服刑人員改造表現(xiàn)泛勞動(dòng)化傾向、減刑適用程序僵硬化、對(duì)服刑人員減刑后的監(jiān)督監(jiān)管薄弱、減刑執(zhí)行過程中容易出現(xiàn)權(quán)錢交易等問題，本文嘗試從減刑的適用角度分析減刑制度概述、減刑適用中存在的問題以及解決的方法，，建立減刑撤銷制度等方面來完善減刑的適用，希望減刑制度在適用中能更好地發(fā)揮作用。
[Abstract]:The commutation system is an important part of the criminal execution system, and the commutation system is stabilizing the prison supervision order. It has played an important role in encouraging the prisoners to reform and return to society. However, in the process of commutation, there is a tendency of Pan-labor in the reform of prisoners, and the procedure of commutation is rigid. The supervision and supervision of sentence commutation is weak, and power and money transactions are easy to appear in the course of commutation. This paper tries to analyze the summary of commutation system, the problems existing in commutation and the methods to solve it from the perspective of the application of commutation. In order to improve the application of commutation, we hope that the commutation system can play a better role in the application.
