【摘要】：客觀危險(xiǎn)說(shuō)是違法性領(lǐng)域內(nèi)關(guān)于判斷"實(shí)行行為時(shí)法益侵害危險(xiǎn)性"具體方法的學(xué)說(shuō),它包含判斷資料、判斷時(shí)點(diǎn)、判斷主體三個(gè)熱點(diǎn)。判斷資料與判斷主體分屬兩個(gè)階層,客觀危險(xiǎn)說(shuō)只能以"客觀事實(shí)"為評(píng)價(jià)對(duì)象,不允許以判斷主體的認(rèn)知取代客觀資料,不能對(duì)客觀事實(shí)進(jìn)行抽象化,這是刑法客觀主義的根本體現(xiàn)。一次判斷只能站在一個(gè)時(shí)點(diǎn),既然以"事后查明的客觀事實(shí)"為判斷資料,則只能連帶為"事后判斷","事前判斷"與客觀危險(xiǎn)說(shuō)的構(gòu)造相悖。判斷主體不涉及刑法主客觀主義之爭(zhēng),它與判斷資料是"客體評(píng)價(jià)"與"評(píng)價(jià)客體"的階層關(guān)系。危險(xiǎn)的判斷不是純物理性、科學(xué)性的因果關(guān)系判斷,它不得不考慮法益保護(hù)目的的要求,離不開(kāi)價(jià)值判斷的成分,采用"科學(xué)的一般人"是較妥當(dāng)?shù)幕鶞?zhǔn)。
[Abstract]:Objective danger is the theory about the judgment of "action as the law against the risk of" the specific methods of illegality field, it includes judgment, judgment to determine the main point, three hot spots. Judge data and judge the subject belonging to two classes, the objective dangerousness can only be "objective facts" as the evaluation object, not allowed objective to determine the main data instead of cognition, not the abstraction of objective facts, which is the fundamental embodiment of objectivism. A judge can stand on a point in time, since the "objective facts" are found later to judge the data, only joint as "post judgment", "ex ante" contrary structure with the objective danger. The subjects of the judgment does not involve criminal subjective doctrine of the dispute, it is "the object of evaluation and judgment" and "evaluation object hierarchy. The dangerous judgment is not a pure physical, scientific judgment of causality It has to take into account the requirements of the purpose of protecting the legal interests, which can not be separated from the components of the value judgment, and the use of "scientific general people" is a more appropriate benchmark.
