【摘要】：隨著信息技術的不斷發(fā)展,信息網(wǎng)絡對人們?nèi)粘Ｉ畹挠绊懞蜐B透程度日益加深,許多不法分子利用網(wǎng)絡的空間化和虛擬化開始進行網(wǎng)絡犯罪,這對于刑法的約束是一項艱巨的挑戰(zhàn)。本文將對網(wǎng)絡空間化的時代演變角度進行分析,并充分介紹網(wǎng)絡空間化發(fā)展過程中與刑法之間的深刻關系,同時借由網(wǎng)絡信息的特征,試歸納出刑法在面對網(wǎng)絡虛擬犯罪時所應采取的相關對策。
[Abstract]:With the development of information technology, the influence and penetration of information network on people's daily life is deepening day by day. Many criminals begin to commit cybercrime by using the space and virtualization of the network. This is a difficult challenge to the restriction of criminal law. This paper will analyze the evolution of cyberspace and introduce the profound relationship between cyberspace and criminal law in the process of cyberspace development. At the same time, by the characteristics of network information, this paper sums up the relevant countermeasures that criminal law should take in the face of network virtual crime.
