【摘要】：正在當(dāng)下,我們?nèi)绾卧u(píng)價(jià)與看待我國(guó)憲法實(shí)施上存在的三個(gè)問(wèn)題:第一,現(xiàn)行憲法實(shí)施的狀況是怎樣的?如何評(píng)價(jià)?第二,構(gòu)建以權(quán)利救濟(jì)為核心的憲法實(shí)施制度的必要性;第三,如何建構(gòu)以權(quán)利救濟(jì)為核心的憲法實(shí)施制度。我國(guó)現(xiàn)行憲法實(shí)施狀況的總體評(píng)價(jià)人們關(guān)于我國(guó)現(xiàn)行憲法實(shí)施狀況的總體評(píng)價(jià),大致上存在兩種截然相反的觀點(diǎn):一是認(rèn)為憲法實(shí)施得好;一是認(rèn)為憲法實(shí)施得不好。評(píng)價(jià)標(biāo)準(zhǔn)不同,其得出的結(jié)論亦會(huì)迥異。認(rèn)為我國(guó)現(xiàn)行憲法實(shí)施得好的觀點(diǎn)是基于憲法實(shí)施是
[Abstract]:At present, how do we evaluate and treat the three problems existing in the implementation of the Constitution of our country: first, what is the status of the implementation of the present Constitution? What do you think? Second, the necessity of constructing the constitutional enforcement system with the right relief as the core, and the third, how to construct the constitutional enforcement system with the right relief as the core. The overall Evaluation of the implementation of the present Constitution in China there are generally two opposite views: one is that the Constitution is implemented well and the other is that the Constitution is not implemented well. The evaluation criteria will be different, and the conclusions will be very different. The view that the current constitution of our country has been implemented well is based on the implementation of the constitution.
