【摘要】：憲法是權(quán)利保護(hù)的權(quán)威者,具有最高的法律位階,為了維護(hù)憲法的最高權(quán)威,需要有相關(guān)的憲法解釋制度建立確保憲法的實(shí)施,保障權(quán)利不受侵犯,維護(hù)憲法的根本法地位。臺灣地區(qū)的大法官釋憲制度是保證“憲法”實(shí)施的重要制度,大法官釋憲的對象不僅包括憲法規(guī)則本身,也包括對那些貌似民事權(quán)利實(shí)則為憲法權(quán)利的界定和闡釋,家庭權(quán)利就是其中一例。本文關(guān)注臺灣大法官對家庭權(quán)利的憲法解釋,力求通過對解釋文獻(xiàn)的分析和比較,探究大法官基于權(quán)利保護(hù)立場上所采用的憲法解釋標(biāo)準(zhǔn)及解釋過程中所運(yùn)用的憲法解釋方法。臺灣地區(qū)與大陸的文化具有同源性,因此臺灣地區(qū)大法官對家庭權(quán)利的憲法解釋對中國大陸的憲法解釋及法治發(fā)展有著重大和現(xiàn)實(shí)的借鑒意義。
[Abstract]:Constitution is the authority of the protection of rights, which has the highest legal rank. In order to maintain the highest authority of the constitution, it is necessary to establish the relevant system of constitutional interpretation to ensure the implementation of the constitution, to guarantee the right not to be infringed, and to safeguard the status of the basic law of the constitution. The system of interpretation of the constitution by the justices of Taiwan is an important system to ensure the implementation of the Constitution. The object of the interpretation of the constitution by the justices includes not only the constitutional rules themselves, but also the definition and interpretation of the constitutional rights that appear to be civil rights in fact. Family rights are one example. This paper focuses on the constitutional interpretation of family rights by Taiwan justices, and tries to explore the standards of constitutional interpretation adopted by the justices on the basis of protection of rights and the methods used in the process of interpretation through the analysis and comparison of the explanatory documents. The culture of Taiwan region is similar to that of mainland China. Therefore, the constitutional interpretation of family rights by the justices of Taiwan has great and practical significance for the constitutional interpretation and the development of rule of law in mainland China.
