【摘要】：從傳統(tǒng)鄉(xiāng)土社會走向現(xiàn)代民主社會,是中國法治型道路的必然選擇。在社會轉(zhuǎn)型中,必然帶來不同主體間的利益博弈。作為中國最大弱勢群體的中國農(nóng)民如何在利益博弈中主張并實現(xiàn)自己的利益,已經(jīng)成為當(dāng)前社會不可回避的緊迫問題。中國農(nóng)民的政治訴愿權(quán)本應(yīng)是一種自然的政治權(quán)利,但卻在社會現(xiàn)實中未能得到法律上有效認(rèn)可和社會制度有效保障。權(quán)利的生命在于運行。中國農(nóng)民在過去、現(xiàn)在乃至未來都是中國社會前進的主要推動者。正處于社會轉(zhuǎn)型的中國必須充分認(rèn)識、尊重并有效保障中國農(nóng)民的政治訴愿權(quán)。
[Abstract]:Moving from traditional local society to modern democratic society is the inevitable choice of the road of rule of law in China. In the social transformation, it will inevitably bring about the benefit game between different subjects. As the most vulnerable group in China, how Chinese farmers advocate and realize their own interests in the interest game has become an unavoidable and urgent problem in the current society. The political appeal right of Chinese peasants is supposed to be a kind of natural political rights, but it has not been effectively recognized by law and protected by social system in social reality. The life of right lies in operation. Chinese farmers in the past, present and even future are the main propellants of Chinese society. In the process of social transformation, China must fully recognize, respect and effectively protect the political appeal rights of Chinese farmers.
