【摘要】： 村民自治作為社會(huì)主義民主政治的偉大創(chuàng)造,正成為中國(guó)民主化進(jìn)程的基石。以往關(guān)于村民自治的研究成果大多集中在社會(huì)學(xué)和政治學(xué)領(lǐng)域,從法學(xué)的視角特別是對(duì)村民自治的法律保障問題研究成果還不多。在村民自治的實(shí)踐過程中,我們經(jīng)常會(huì)碰到許多棘手的法律問題而束手無策。本文就試從憲法學(xué)、法理學(xué)等法學(xué)視域去探求村民自治在中國(guó)民主進(jìn)程中的地位、作用;希圖通過對(duì)現(xiàn)行關(guān)于村民自治法律、法規(guī)的缺陷的分析,利用法學(xué)的分析方法論述村民自治的法制精神及在實(shí)踐中出現(xiàn)的各種法律關(guān)系問題,從立法和司法兩個(gè)方面闡述如何建構(gòu)完善的村民自治法律保障體系,促進(jìn)村民自治在法律的維度內(nèi)有序發(fā)展。
[Abstract]:As a great creation of socialist democratic politics, villager autonomy is becoming the cornerstone of China's democratization process. In the past, the research on villager autonomy mostly concentrated in the field of sociology and political science, but not much from the perspective of law, especially on the legal guarantee of villager autonomy. In the practice of villager autonomy, we often encounter a lot of difficult legal problems. This paper tries to explore the status and role of villager autonomy in the process of democracy in China from the perspectives of constitutional jurisprudence and jurisprudence. By analyzing the defects of the existing laws and regulations on villagers' autonomy and using the analytical method of law, the author discusses the spirit of the legal system of villagers' autonomy and various legal relations in practice. This paper expounds how to construct a perfect legal guarantee system of villager autonomy from two aspects of legislation and judicature to promote the orderly development of villager autonomy in the dimension of law.
