基本權(quán)利視野下的香港社會(huì)運(yùn)動(dòng)

【摘要】:香港在回歸前后,無(wú)論是經(jīng)濟(jì)還是社會(huì)都發(fā)生了翻天覆地的變化,但是沒(méi)有改變的是香港社會(huì)中普遍存在的一種社會(huì)現(xiàn)象,那就是香港社會(huì)運(yùn)動(dòng)。當(dāng)然伴隨著香港的回歸,香港社會(huì)運(yùn)動(dòng)還是發(fā)生了一些顯著變化的。香港社會(huì)運(yùn)動(dòng)與傳統(tǒng)社會(huì)運(yùn)動(dòng)不同,它有自己鮮明的特點(diǎn)和獨(dú)特的類(lèi)型。香港社會(huì)運(yùn)動(dòng)這些顯著的特征是在特定背景下形成的。香港社會(huì)運(yùn)動(dòng)一般是有秩序進(jìn)行的,并且每次香港社會(huì)運(yùn)動(dòng)都能夠引起香港政府的互動(dòng)。 本文從香港特別行政區(qū)發(fā)生的社會(huì)運(yùn)動(dòng)出發(fā),研究香港社會(huì)運(yùn)動(dòng)這些顯著特征產(chǎn)生的原因、社會(huì)運(yùn)動(dòng)興起背景以及香港社會(huì)運(yùn)動(dòng)中出現(xiàn)的法律問(wèn)題。香港社會(huì)運(yùn)動(dòng)之所以能夠發(fā)生,是因?yàn)橄愀奂创娴姆芍贫葹槠涮峁┝朔芍贫鹊谋U稀F渲信c香港社會(huì)運(yùn)動(dòng)聯(lián)系最緊密的還是香港居民的基本權(quán)利,香港居民的基本權(quán)利為香港社會(huì)運(yùn)動(dòng)提供了權(quán)利基礎(chǔ)。香港居民基本權(quán)利與香港社會(huì)運(yùn)動(dòng)緊密聯(lián)系體現(xiàn)在以下三個(gè)方面:第一、香港社會(huì)運(yùn)動(dòng)中表達(dá)自己訴求的方式是言論自由的體現(xiàn);第二、香港社會(huì)運(yùn)動(dòng)是一種集體行動(dòng),集體行動(dòng)是集會(huì)自由的體現(xiàn);第三、香港社會(huì)運(yùn)動(dòng)多半都是由固定組織發(fā)起的,這些固定組織的成立也是結(jié)社自由的體現(xiàn)。 香港社會(huì)運(yùn)動(dòng)是與基本權(quán)利緊密相關(guān)的,基本權(quán)利不僅僅是社會(huì)運(yùn)動(dòng)發(fā)起的權(quán)利基礎(chǔ),而且香港法律制度通過(guò)對(duì)基本權(quán)利的保障以及通過(guò)對(duì)基本權(quán)利的限制來(lái)保障香港社會(huì)運(yùn)動(dòng)合法有序的進(jìn)行。本文分為五個(gè)部分,第一部分闡述社會(huì)運(yùn)動(dòng)和基本權(quán)利關(guān)系的基本理論,分析基本權(quán)利對(duì)社會(huì)運(yùn)動(dòng)的保障、社會(huì)運(yùn)動(dòng)的發(fā)生對(duì)基本權(quán)利產(chǎn)生影響。第二部分對(duì)比香港回歸前后發(fā)生的社會(huì)運(yùn)動(dòng),從而得出香港社會(huì)運(yùn)動(dòng)的特點(diǎn)、香港社會(huì)運(yùn)動(dòng)興起的背景以及香港社會(huì)運(yùn)動(dòng)的類(lèi)型。第三部分從香港居民言論自由的保障和限制分析言論自由在社會(huì)運(yùn)動(dòng)中的價(jià)值。第四部分分析香港居民集會(huì)自由與香港社會(huì)運(yùn)動(dòng)的關(guān)系,通過(guò)對(duì)香港判例的分析得出香港警察處處長(zhǎng)對(duì)集會(huì)自由自由裁量權(quán)的行使不是任意的,而是根據(jù)法律規(guī)定行使的。第五部分從香港回歸前后成立的主要社會(huì)團(tuán)體組織分析香港社會(huì)運(yùn)動(dòng),香港政黨的發(fā)展影響了社會(huì)運(yùn)動(dòng)的發(fā)展,使香港社會(huì)運(yùn)動(dòng)有了新的特點(diǎn)。
[Abstract]:Before and after the reunification, the economy and society of Hong Kong have undergone earth-shaking changes, but what has not changed is a social phenomenon that is prevalent in Hong Kong society, that is, the social movement in Hong Kong. Of course, with the return of Hong Kong, the social movement in Hong Kong has undergone some significant changes. Hong Kong social movement is different from traditional social movement, it has its own distinctive characteristics and unique types. These salient features of the Hong Kong social movement are formed in a particular context. Social movements in Hong Kong are generally conducted in an orderly manner, and each Hong Kong social movement can lead to interaction with the Hong Kong Government. Starting from the social movement in the Hong Kong Special Administrative region, this paper studies the causes of these remarkable features of the social movement in Hong Kong, the background of the rise of the social movement and the legal problems arising in the social movement in Hong Kong. The reason why Hong Kong social movement can take place is because Hong Kong's immediate legal system provides the protection of its legal system. Among them, the basic rights of Hong Kong residents are the most closely related to the social movement in Hong Kong, and the basic rights of Hong Kong residents provide the right basis for the social movement in Hong Kong. The basic rights of Hong Kong residents are closely related to the Hong Kong social movement in the following three aspects: first, the expression of their demands in the Hong Kong social movement is the embodiment of freedom of speech; Secondly, the social movement in Hong Kong is a kind of collective action, and collective action is the embodiment of freedom of assembly. Third, most of the social movements in Hong Kong are initiated by fixed organizations, and the establishment of these fixed organizations is also the embodiment of freedom of association. The social movement in Hong Kong is closely related to fundamental rights, which are not only the foundation of rights initiated by social movements. Moreover, the Hong Kong legal system ensures the legal and orderly conduct of Hong Kong's social movement through the protection of basic rights and the restriction of basic rights. This paper is divided into five parts. The first part expounds the basic theory of the relationship between social movement and basic rights, and analyzes the protection of basic rights to social movement, the emergence of social movement has an impact on basic rights. The second part compares the social movements that occurred before and after Hong Kong's return to China, so as to obtain the characteristics of the social movements in Hong Kong, the background of the rise of the social movements in Hong Kong and the types of social movements in Hong Kong. The third part analyzes the value of freedom of speech in social movement from the protection and restriction of Hong Kong residents' freedom of speech. The fourth part analyzes the relationship between the freedom of assembly of Hong Kong residents and the social movement in Hong Kong. Through the analysis of the Hong Kong case law, it is concluded that the exercise of the discretion of assembly by the Director of Police in Hong Kong is not arbitrary, but is exercised in accordance with the provisions of the law. The fifth part analyzes the social movements in Hong Kong from the major social organizations set up before and after the handover. The development of political parties in Hong Kong has affected the development of social movements and made the social movements in Hong Kong have new characteristics.
