【摘要】：公民的輿論監(jiān)督權就是公民通過各類傳播媒介,自由地發(fā)表自己的言論,對政府機關、公務人員、社會知名人士、公司法人等的行為進行監(jiān)督的權利。 全文一萬九千余字,共分為三部分。 第一部分闡述公民輿論監(jiān)督權的基本理論。本章首先提出了公民輿論監(jiān)督權的概念,并論證了該項權利的性質(zhì)。接著對公民輿論監(jiān)督權的內(nèi)部構成進行逐項分析。本章還對公民輿論監(jiān)督的特征和公民行使輿論監(jiān)督權基本原則予以說明,并結合法理對其予以了論證分析。 第二部分首先對我國公民輿論監(jiān)督權的法律淵源、政策依據(jù)加以介紹。然后對我國公民行使輿論監(jiān)督權利的現(xiàn)狀進行論述。在論述過程中既介紹了我國公民輿論監(jiān)督工作取得的階段性成果,也指出了公民輿論監(jiān)督工作中存在的若干問題并對這些問題予以了細致深入地分析,以期望找出背后的原因。 第三部分針對我國公民輿論監(jiān)督權在實際運行中存在的問題,提出了要制定一整套法律體系對公民輿論監(jiān)督權加以保護的立法建議。同時提出了一系列具有現(xiàn)實可能性和可操作性的措施,最終目的在于使其監(jiān)督政府工作和為人民群眾謀福利兩方面的效用得到最大限度的發(fā)揮。
[Abstract]:Citizens' right of public opinion supervision is the right of citizens to freely express their opinions through various kinds of media and to supervise the behavior of government organs, public servants, social celebrities, corporations and legal persons. Full text more than 19000 words, a total of three parts. The first part expounds the basic theory of citizen's right of supervision by public opinion. This chapter first puts forward the concept of the right of public opinion supervision, and demonstrates the nature of the right. Then the internal composition of public opinion supervision power is analyzed item by item. This chapter also explains the characteristics of the supervision of public opinion and the basic principles of exercising the right of supervision of public opinion. The second part first introduces the legal origin and policy basis of the right of public opinion supervision in China. Then it discusses the status quo of Chinese citizens exercising the right of public opinion supervision. In the course of the discussion, this paper introduces the stage achievements of the supervision of public opinion in our country, and points out some problems existing in the supervision of public opinion, and makes a detailed and thorough analysis of these problems in order to find out the reasons behind them. In the third part, in view of the problems existing in the actual operation of the right of supervision of public opinion in our country, the author puts forward a set of legislative suggestions to protect the right of supervision of public opinion in a set of laws. At the same time, a series of practical possibility and maneuverability measures are put forward, with the ultimate aim of maximizing the effectiveness of the supervision of government work and the welfare of the people.
