我國(guó)私有財(cái)產(chǎn)權(quán)完善的法理學(xué)思考

【摘要】:對(duì)公民私有財(cái)產(chǎn)權(quán)的法律保護(hù)早已在世界各國(guó)達(dá)成共識(shí),世界經(jīng)濟(jì)強(qiáng)國(guó)對(duì)公民私有財(cái)產(chǎn)權(quán)的法律保護(hù)早已經(jīng)寫進(jìn)憲法和法律并予以實(shí)施,我國(guó)憲法確立對(duì)公民私有財(cái)產(chǎn)權(quán)的法律保護(hù)符合社會(huì)發(fā)展的必然趨勢(shì),也是為構(gòu)建和完善我國(guó)法律體系奠定了基礎(chǔ)。對(duì)公民私有財(cái)產(chǎn)的法律保護(hù)應(yīng)當(dāng)注意以下幾點(diǎn):必須牢固樹立憲法至上的基本理念;必須深刻理解私有財(cái)產(chǎn)權(quán)與私有制度的不同概念;必須正確處理公權(quán)力與私權(quán)利的關(guān)系;必須進(jìn)一步健全和完善各項(xiàng)保護(hù)制度以及公民的權(quán)利意識(shí)與責(zé)任意識(shí)的培養(yǎng),只有在以上幾點(diǎn)注意到,尤其是在我國(guó)社會(huì)轉(zhuǎn)型時(shí)期,法治社會(huì)秩序才能順利構(gòu)造成功。 私有財(cái)產(chǎn)權(quán)是人權(quán)的保障,它的存在證明具有一定的正當(dāng)性并且具有深刻的社會(huì)觀念基礎(chǔ),由于東西方文化背景存在多方面以及巨大的差異造成人們對(duì)待私有財(cái)產(chǎn)權(quán)的觀念差異,原因是中西社會(huì)在權(quán)利概念方面具有很大不同,仁義作為我國(guó)文化邏輯起點(diǎn),而西方是正義為邏輯起點(diǎn);重義輕利是我國(guó)文化中的精神特質(zhì),而西方文化以功利主義著稱;中國(guó)文化以群體為本位,以王權(quán)作為最高權(quán)威,個(gè)體是西方文化的本位,以終極權(quán)威對(duì)抗實(shí)在法的合法性,從以上諸多觀念的差別看出,如要成功地構(gòu)造法治社會(huì),我們?cè)诮ㄔO(shè)中應(yīng)深度發(fā)掘中國(guó)傳統(tǒng)文化中的人道精神,并且把這種人道精神與西方權(quán)利文化相結(jié)合,才能在我培植能讓國(guó)財(cái)產(chǎn)權(quán)健康發(fā)展的文化土壤。 在當(dāng)今的中國(guó),幾次修憲均圍繞著私有財(cái)產(chǎn)權(quán)改革,可見對(duì)私有財(cái)產(chǎn)保護(hù)的緊迫性比以前已有更為普遍的共識(shí),但是許多人對(duì)憲法是否應(yīng)該保障私有財(cái)產(chǎn)和相應(yīng)的私有財(cái)產(chǎn)權(quán)卻有很大的分歧,學(xué)者們基本上都認(rèn)為憲法意義上的財(cái)產(chǎn)權(quán)應(yīng)該是公民的基本權(quán)利,但在對(duì)基本權(quán)利的具體理解上有較大差異,多數(shù)學(xué)者未能較好地區(qū)分憲法上的財(cái)產(chǎn)權(quán)和民法上的財(cái)產(chǎn)權(quán),或者雖作區(qū)分但不能準(zhǔn)確地予以區(qū)分,在防范公權(quán)力侵害私人財(cái)產(chǎn)方面,無論是法律制度方面還是生活中的行政執(zhí)法或者是法律保障的最后一道強(qiáng)的司法實(shí)踐方面,都非常薄弱,人們都希望擁有獨(dú)立和安全的個(gè)人幸福生活的個(gè)人空間以及社會(huì)安全、政治安定、經(jīng)濟(jì)持續(xù)健康發(fā)展的大環(huán)境,希望我們能實(shí)現(xiàn)對(duì)私人財(cái)產(chǎn)的一體化保護(hù)、私人財(cái)產(chǎn)和公共財(cái)產(chǎn)的平等保護(hù)。但現(xiàn)實(shí)我們是匱乏對(duì)私人財(cái)產(chǎn)的公法保障,這方面法律的漏洞已經(jīng)成為阻礙我國(guó)社會(huì)經(jīng)濟(jì)發(fā)展和法治建設(shè)發(fā)展的絆腳石。 學(xué)生擔(dān)心的是在貧富階層矛盾下社會(huì)突發(fā)事件一觸即發(fā),所以對(duì)私有財(cái)產(chǎn)權(quán)的研究具有十分重要的學(xué)術(shù)和實(shí)踐意義,然而對(duì)私有財(cái)產(chǎn)權(quán)的保護(hù)并不會(huì)自動(dòng)生成,我們必須在學(xué)術(shù)和實(shí)踐中足夠地重視,否則,會(huì)因?yàn)樗接胸?cái)產(chǎn)權(quán)沒有強(qiáng)有力的法律后盾而導(dǎo)致財(cái)產(chǎn)侵權(quán)事件頻繁發(fā)生,因此引出一系列的社會(huì)問題,更有甚者會(huì)導(dǎo)致財(cái)產(chǎn)外流,現(xiàn)今社會(huì)已經(jīng)出現(xiàn)這些問題,本文的目的是在私人財(cái)產(chǎn)得到法律保護(hù)情況下有利于保障公民權(quán)利的實(shí)現(xiàn),推進(jìn)依法治國(guó),正確理清財(cái)產(chǎn)權(quán)利、社會(huì)義務(wù)以及公權(quán)力的關(guān)系,只有理清這一系列的關(guān)系,以人為本的立場(chǎng)出發(fā),更多的從實(shí)踐角度出發(fā),只有理論和實(shí)踐相結(jié)合才可能調(diào)動(dòng)廣大人民群眾的積極性和創(chuàng)造性,全面建設(shè)小康社會(huì)。

The private property right is the guarantee of human rights, its existence proves to have a certain legitimacy and has a profound social idea foundation, because the cultural background of the east and the west exists in many ways and the huge difference causes people to treat the idea of private property right The reason is that the Chinese and the western society has a great difference in the concept of rights, Renyi serves as the starting point of the cultural logic of our country, and the West is the starting point of the logic, and the western culture is the spiritual characteristic of our culture, and the western culture is famous for utilitarianism. As the highest authority, the individual is the standard of the western culture, and the ultimate authority opposes the legitimacy of the real law. From the difference of the above ideas, it can be seen that, if the rule of law society is to be constructed successfully, we should deeply explore the people in the traditional Chinese culture in the construction. The spirit of this kind of spirit is combined with the western right culture in order to cultivate the culture that can make the country's property right healthy. In today's China, the changes of private property rights have been carried out several times in China. It is found that the urgency of the protection of private property is more common than before, but many people have a view of whether the constitution should guarantee private property and the corresponding private property right.
