【摘要】：村委會(huì)選舉是我國(guó)社會(huì)主義民主在農(nóng)村最重要的實(shí)踐形式之一。從1988年6月《村委會(huì)組織法》頒布試行,村委會(huì)選舉工作在全國(guó)各地農(nóng)村深入開(kāi)展,這對(duì)保障村民自治、發(fā)展農(nóng)村基層民主發(fā)揮了重要作用。但在村委會(huì)選舉實(shí)踐中,村民選舉權(quán)利卻常常受到來(lái)自基層鄉(xiāng)鎮(zhèn)行政權(quán)不當(dāng)干預(yù)的侵害。本文通過(guò)分析村委會(huì)選舉中不當(dāng)行政干預(yù)現(xiàn)象,發(fā)現(xiàn)其形成的主要原因在于:壓力型體制、當(dāng)選者的逐利動(dòng)機(jī)、制度供給不足以及直接民主的局限性。為此,文章建議只有通過(guò)確立法律至上思想,完善權(quán)力授予的法律機(jī)制,選舉程序法定化,健全法律監(jiān)督機(jī)制等法律制度設(shè)計(jì),才能保障村民選舉權(quán)的真正實(shí)現(xiàn),促進(jìn)村民自治的健康發(fā)展。 本文擬從三個(gè)部分進(jìn)行論述。第一部分先對(duì)村委會(huì)選舉相關(guān)理論進(jìn)行了梳理,然后概述目前村委會(huì)選舉過(guò)程中存在的基層鄉(xiāng)鎮(zhèn)政府行政干預(yù)問(wèn)題;第二部分以大量案例為支撐,將村委會(huì)選舉過(guò)程中基層政府行政權(quán)的不當(dāng)干預(yù)行為分為:不當(dāng)組織、不當(dāng)指導(dǎo)、不當(dāng)確認(rèn)、不當(dāng)處理,并對(duì)不當(dāng)干預(yù)的原因進(jìn)行剖析;第三部分從法律社會(huì)學(xué)角度,提出規(guī)制基層鄉(xiāng)鎮(zhèn)行政權(quán)不當(dāng)干預(yù)的法律建議,包括確立法律至上思想、完善權(quán)力授予的法律機(jī)制等等。
[Abstract]:Village committee election is one of the most important practical forms of socialist democracy in rural areas. Since the promulgation and trial of the Organic Law of the Village Committee in June 1988, the election of the village committee has been carried out in depth throughout the country, which has played an important role in guaranteeing villagers' autonomy and developing rural democracy at the grass-roots level. However, in the practice of village committee election, villagers' right to vote is often infringed by improper interference of administrative power from grassroots villages and towns. By analyzing the phenomenon of improper administrative intervention in the election of village committee, this paper finds that the main reasons for its formation lie in the pressure system, the motivations of those who are elected for profit, the shortage of system supply and the limitation of direct democracy. Therefore, the article suggests that only by establishing the idea of the supremacy of law, perfecting the legal mechanism of the delegation of power, legalizing the election procedure, perfecting the legal supervision mechanism, and so on, can the villagers' right to vote be truly realized. To promote the healthy development of villagers' autonomy. This paper discusses from three parts. The first part of the village committee election related theories were combed, then summarized the village committee election process in the existing grass-roots township government administrative intervention; the second part is supported by a large number of cases, The improper intervention of the administrative power of the grass-roots government in the election process of the village committee is divided into: improper organization, improper guidance, improper confirmation, improper handling, and the analysis of the causes of improper intervention; the third part is from the angle of legal sociology. This paper puts forward some legal suggestions to regulate the improper intervention of the administrative power of the grassroots villages and towns, including establishing the idea of the supremacy of law and perfecting the legal mechanism of the delegation of power.
