【摘要】：民族自治法規(guī)立法是全面落實民族區(qū)域自治制度的重要法制保障,而民族自治法規(guī)立法程序則是保障優(yōu)良民族自治法規(guī)出臺的基礎(chǔ)。然而,由于我國立法素來有重實體輕程序的傳統(tǒng),所以目前理論界也是對民族自治法規(guī)本身的研究較為深入,對自治條例和單行條例的立法程序的研究較少。本文試圖在前人研究的基礎(chǔ)上對民族自治法規(guī)立法程序進行進一步的研究,并提出相應的建設性意見和建議。全文共分五部分： 第一章是緒論。主要對研究背景、研究現(xiàn)狀、研究目的和意義進行介紹。 第二章是對民族自治法規(guī)及立法程序的概述。首先是對民族自治法規(guī)的概述。在這部分對民族自治法規(guī)概念、特征和變通規(guī)定和補充規(guī)定的性質(zhì)一些基本概念進行了論述。其次是對民族自治法規(guī)立法程序的概述。在這部分筆者介紹了民族自治法規(guī)立法程序概念及主要階段和我國關(guān)于民族自治法規(guī)立法程序立法現(xiàn)狀 第三章是對民族自治法規(guī)立法程序存在問題分析。得出結(jié)論如下：首先,中央一級的統(tǒng)一規(guī)定過于籠統(tǒng)。其次,各自治區(qū)并無關(guān)于民族自治法規(guī)立法程序的專門規(guī)定。再次,現(xiàn)有自治地方的民族自治法規(guī)立法程序規(guī)定形式不統(tǒng)一。最后,.主要程序設置存在問題：提案程序存在問題、審議程序存在問題、表決程序存在問題、批準程序存在問題、違反立法程序責任制度的缺失。 第四章對完善民族自治法規(guī)立法程序的必要性和可行性進行了分析。對于必要性的分析：首先,體現(xiàn)正當立法程序自身價值的需要。其次,程序法是實體法的保證。第三,推動我國立法程序發(fā)展的需要。第四,有助于法治的實現(xiàn)。最后,全面落實民族區(qū)域自治制度的需要。對于可行性的分析：首先,有相關(guān)理論研究做準備。其次,實踐中存在大量值得借鑒的立法程序規(guī)定。再次,民族自治法規(guī)立法程序規(guī)定不斷發(fā)展。最后,人大自身建設不斷完善。 第五章關(guān)于完善民族自治法規(guī)立法程序的幾點建議。首先,明確提出在《民族區(qū)域自治法》中增加專節(jié)對民族區(qū)域自治法規(guī)的不完善之處做專門統(tǒng)一的規(guī)定。其次,提出完善主要程序的具體措施。如：解決提案程序中存在的問題；健全審議程序；修改表決程序；規(guī)范審批程序；增加違反立法程序責任條款。
[Abstract]:The legislation of national autonomy laws and regulations is an important legal guarantee to implement the system of regional national autonomy in an all-round way, while the legislative procedure of national autonomy laws and regulations is the basis for ensuring the promulgation of excellent national autonomy laws and regulations. However, because of the tradition that the legislation of our country has always attached importance to the entity and the procedure, the theoretical circle is also deeply studying the national autonomy law itself, and the research on the legislative procedure of the autonomy regulation and the special regulation is less. This paper attempts to further study the legislative procedures of national autonomy laws and regulations on the basis of previous studies, and puts forward corresponding constructive suggestions and suggestions. The full text is divided into five parts: the first chapter is the introduction. This paper mainly introduces the background, present situation, purpose and significance of the research. The second chapter is an overview of the national autonomy laws and regulations and legislative procedures. First of all, the overview of the national autonomy laws and regulations. In this part, some basic concepts of the concept, characteristics, flexible provisions and supplementary provisions of national autonomous laws and regulations are discussed. Secondly, it summarizes the legislative procedure of national autonomy laws and regulations. In this part, the author introduces the concept and the main stages of the legislative procedure of the national autonomous laws and regulations, and the third chapter analyzes the problems existing in the legislative procedure of the national autonomy laws and regulations in the third chapter. The conclusions are as follows: first, the uniform provisions at the central level are too general. Secondly, the autonomous regions have nothing to do with the special provisions of the legislative procedures of the national autonomous laws and regulations. Third, the existing autonomous areas of national autonomy laws and regulations of the legislative procedures of the form is not unified. Finally. There are problems in the main procedure: the proposal procedure, the deliberative procedure, the voting procedure, the approval procedure, and the lack of the responsibility system of the legislative procedure. Chapter four analyzes the necessity and feasibility of perfecting the legislative procedure of national autonomy laws and regulations. Analysis of necessity: first of all, the need to reflect the value of due process. Secondly, procedural law is the guarantee of substantive law. Third, the need to promote the development of China's legislative process. Fourth, contribute to the realization of the rule of law. Finally, to fully implement the system of regional national autonomy needs. For feasibility analysis: first, there are relevant theoretical research to prepare. Secondly, there are a large number of legislative procedures that are worth learning from in practice. Thirdly, the legislative procedures of national autonomy laws and regulations are constantly developing. Finally, the National people's Congress itself is constantly improving. The fifth chapter is about perfecting the legislative procedure of national autonomous laws and regulations. Firstly, a special section is added to the Law of Regional National Autonomy to regulate the imperfections of the laws and regulations of regional national autonomy. Secondly, the concrete measures to perfect the main procedure are put forward. For example: to solve the problems existing in the proposal procedure; to perfect the deliberation procedure; to revise the voting procedure; to standardize the approval procedure; to add the clause of violating the responsibility of the legislative procedure.
