【摘要】：農(nóng)村基層黨組織對村民自治的領(lǐng)導地位實質(zhì)上表現(xiàn)為法律和政策的監(jiān)督權(quán),并不是行政化的直接領(lǐng)導�！饵h的基層組織工作條例》和《村民委員會組織法》應(yīng)當具體規(guī)定農(nóng)村基層黨組織行使職能的法律方式和路徑,進一步將這種特殊意義的領(lǐng)導程序化和權(quán)利化。樹立崇尚法律和依法治村的觀念,遵循權(quán)利平等和村民自治原則,按照法律的邏輯和思維設(shè)定領(lǐng)導職能、轉(zhuǎn)變領(lǐng)導方式以及選擇爭議解決路徑具有重要意義。
[Abstract]:In fact, the leadership position of the rural grassroots party organizations over villagers' autonomy is embodied in the power of supervision of laws and policies. "the regulations on the work of the Party's Grass-roots organizations" and the "Organic Law of the villagers' Committees" should specify the legal methods and paths for rural grass-roots party organizations to exercise their functions, Further will this special significance of the leadership procedures and rights. It is of great significance to establish the concept of advocating law and ruling villages according to law, to follow the principle of equal rights and autonomy of villagers, to set up the leading function according to the logic and thinking of law, to change the way of leadership and to choose the path of dispute settlement.
