論村委會選舉中的“賄

【摘要】：村民委員會選舉是我國社會主義民主進程中一項偉大的基層民主實踐。現(xiàn)階段,我國的村民自治主要是通過村民民主選舉村民委員會來展開的。為了更好的舉行村民選舉活動,我國陸續(xù)頒布了一系列的法律。其中,1982年12月4日頒布的《憲法》中第111條的規(guī)定為村民自治的丌展奠定了最高的法律基礎(chǔ),1987年11月24日《村民委員會組織法(試行)》的頒布,則為村委會選舉的正式開展提供了具體的法律指導。根據(jù)農(nóng)村經(jīng)濟社會發(fā)展的需要,1998年11月4日第九屆全國人民代表大會常務(wù)委員會第5次會議對《村民委員會組織法(試行)》進行了修改,《村民委員會組織法》正式實施。與此同時,各省、自治區(qū)、直轄市也根據(jù)自己的實際情況頒布了一系列的地方性法規(guī)以組織實施。村民選舉,這一極具開創(chuàng)性的民主實踐在古老的中國農(nóng)村正式拉開了序幕。我國農(nóng)村實行村委會選舉的這段時間,正是我國實施改革丌放以來發(fā)展變化最快的時期。由于我們是摸著石頭過河,因此在村委會選舉的過程當中也隨之出現(xiàn)了很多問題。“賄選”就是其中比較突出的一點。 本文試圖通過對賄選的本質(zhì)、現(xiàn)狀、成因進行分析,來得出賄選的治理措施。本文試圖對前人的研究有所超越,因此,本文在對賄選的探討過程中所得出的一些分析和結(jié)論可能會對當前的主流觀點形成挑戰(zhàn),本文或許并不能夠很好的找到解決問題的方法或途徑,但是我想一定會對當前的研究現(xiàn)狀做出一些啟迪。 第一部分主要是論述了賄選的本質(zhì)問題。首先是概述了對賄選的研究現(xiàn)狀。其次,通過研究村委會選舉制度的由來,我們從中引申出了村委會選舉中村民的自治權(quán)利。接著,我們以村民自治權(quán)為切入點對賄選的本質(zhì)問題進行探討,進而得出結(jié)論。 第二部分主要是論述了賄選的現(xiàn)狀問題。這一部分首先是論述了賄選的特點,其次是論述了賄選的危害。本部分主要指出了治理賄選現(xiàn)象的緊迫性。 第三部分主要是論述了賄選的成因問題。這一部分首先是對當下關(guān)于賄選成因的批判。其次,運用法經(jīng)濟學和公共選擇理論、以及博弈論等方法對賄選成因進行深層次的分析,以求得相對符合實際的答案。 第四部分主要是論述了賄選的治理問題。我們首先對當前的治理措施進行反思。其次,我們重點從完善和保護村民的自治權(quán)利入手,對具體的治理措施進行論述。
[Abstract]:The election of villagers' committee is a great practice of grassroots democracy in the process of socialist democracy in our country. At present, villager autonomy in our country is mainly carried out through villagers' democratic election of villagers' committee. In order to better hold the villagers election activities, China has promulgated a series of laws. Among them, the provisions of Article 111 of the Constitution promulgated on December 4, 1982, laid the highest legal foundation for the development of villagers' autonomy. On 24 November 1987, the Organic Law of the villagers' Committees (on trial) was promulgated. It provides specific legal guidance for the formal development of village committee elections. In accordance with the needs of rural economic and social development, the Fifth meeting of the standing Committee of the Ninth National people's Congress on November 4, 1998 amended the Organic Law of the villagers' Committee (trial), and the Organic Law of the villagers' Committee was formally implemented. At the same time, provinces, autonomous regions and municipalities have promulgated a series of local laws and regulations according to their own actual conditions. Villagers' election, a pioneering democratic practice in the ancient Chinese countryside officially opened the curtain. The period of village committee election in our country is the fastest developing period since the reform and opening. Since we crossed the river by feeling the stone, there were many problems during the village committee election. "bribery election" is one of the more prominent points. This paper attempts to analyze the nature, present situation and causes of bribery election, and then obtain the measures to deal with bribery election. This paper attempts to transcend the previous studies. Therefore, some analysis and conclusions obtained in the course of the discussion of bribery election may challenge the current mainstream views. This article may not be able to find a good way to solve the problem, but I think it will certainly give some enlightenment to the current research situation. The first part mainly discusses the essence of bribery. First of all, it summarizes the research status of bribery election. Secondly, by studying the origin of the village committee election system, we derive the villagers' autonomy right in the village committee election. Then, we discuss the essence of bribery from the perspective of villager autonomy, and then draw a conclusion. The second part mainly discusses the current situation of bribery election. This part first discusses the characteristics of bribery election, and then discusses the harm of bribery election. This part mainly points out the urgency of controlling the phenomenon of bribery. The third part mainly discusses the causes of bribery. This part is the first part of the current on the cause of bribery criticism. Secondly, we use the methods of law and economics, public choice theory, and game theory to analyze the causes of bribery in order to get a relatively realistic answer. The fourth part mainly discusses the governance of bribery election. We first reflect on the current governance measures. Secondly, we focus on the improvement and protection of villagers' right to autonomy, to discuss the specific governance measures.
