【摘要】：無(wú)戶籍人員生活在我國(guó)社會(huì)的最底層,憲法上賦予公民的基本權(quán)利,也就是中國(guó)認(rèn)可的那部分人權(quán),并沒(méi)有平等地給予所有的中華人民共和國(guó)公民。盡管無(wú)戶籍人員擁有中華人民共和國(guó)國(guó)籍,但由于上世紀(jì)計(jì)劃生育政策的出臺(tái),戶籍管理制度的異化等原因造成了無(wú)戶籍人員人權(quán)備受侵犯的局面。本文第一部分首先從無(wú)戶籍人員的概念談起�，F(xiàn)實(shí)中無(wú)戶籍人員現(xiàn)象并未引起太多的關(guān)注,以致于研究其權(quán)利保障的更是寥寥,所以對(duì)于無(wú)戶籍人員的學(xué)術(shù)定義并沒(méi)有一個(gè)清晰的概念,作者試圖從無(wú)戶籍人員的概念、無(wú)戶籍人員群體的構(gòu)成以及本文無(wú)戶籍人員的范疇界定三個(gè)部分詮釋無(wú)戶籍人員的內(nèi)涵和外延。接著分析無(wú)戶籍人員人權(quán)保障困境形成的原因,爾后指出對(duì)無(wú)戶籍人員人權(quán)應(yīng)予以保障的理論基礎(chǔ)。本文第二部分則分別探討了國(guó)外關(guān)于弱勢(shì)群體人權(quán)保障制度的借鑒和國(guó)內(nèi)關(guān)于無(wú)戶籍人員人權(quán)保障的不足,最后一部分則是試圖分別從無(wú)戶籍人員人權(quán)保障的理念的構(gòu)建,立法、執(zhí)法、司法(救濟(jì))的完善以彌補(bǔ)現(xiàn)有無(wú)戶籍人員人權(quán)保障制度的不足。
[Abstract]:People without household registration live at the bottom of our society, and the basic rights given to citizens by the Constitution, that is, the part of human rights recognized by China, are not given equally to all citizens of the people's Republic of China. Although the non-registered residents have the nationality of the people's Republic of China, due to the introduction of the family planning policy in the last century, the alienation of the household registration management system and other reasons, the human rights of the non-registered residents have been infringed. The first part of this article begins with the concept of no household registration personnel. In reality, the phenomenon of no registered permanent residence personnel has not attracted much attention, so that very few people have studied the protection of their rights. Therefore, there is no clear concept of the academic definition of people without household registration, and the author tries to understand the concept of people without household registration. The composition of the group of non-registered residents and the definition of the category of the non-registered residents in this paper explain the connotation and extension of the non-registered residents. Then it analyzes the reasons for the plight of the human rights protection of the non-registered residents, and points out the theoretical basis for the protection of the human rights of the non-registered residents. The second part of this paper discusses the foreign human rights protection system for vulnerable groups and the lack of human rights protection in China. The last part is to try to construct the concept of the human rights protection of non-registered residents. Legislation, law enforcement, judicial (relief) to make up for the existing lack of hukou personnel human rights protection system.
