【摘要】：人文關(guān)懷是誕生自人文主義基礎(chǔ)之上卻又高于人文主義的理論，，而憲法作為國家的根本大法，實際上是通過規(guī)定國家的運行規(guī)則以及對國家權(quán)力予以規(guī)制來實現(xiàn)它關(guān)懷人、尊重人并且為人的發(fā)展提供良好平臺的使命。因此人文關(guān)懷作為憲法密不可分的固有品質(zhì)，一直以來是伴隨著憲法的發(fā)展而不斷進步。本文深入解析憲法的人文價值與人文關(guān)懷實質(zhì)，是為我們黨和政府開展工作提供理論保障，也是堅定人民群眾對于我們黨和國家信心的“定心丸”。黨的十八大剛剛召開，正是改革發(fā)展呈現(xiàn)出無限活力的良好形勢之時，維持社會穩(wěn)定，實現(xiàn)社會和諧是保證當(dāng)前大好局面的重要前提。而在實踐中將憲法的人文關(guān)懷落到實處，正是保大局促和諧不可或缺的力量。 本文首先提出人文主義的源流并且就產(chǎn)生于其基礎(chǔ)之上的人文關(guān)懷進行了定義，然后就憲法的人文關(guān)懷與憲法的關(guān)系進行了闡釋，并且以英、法、美三國憲法發(fā)展為例通過實證分析的方法解讀憲法的人文關(guān)懷內(nèi)涵與特征。最后，落腳中國的實際，筆者就中國憲法的發(fā)展現(xiàn)狀、存在的問題以及問題解決途徑提出了自己的觀點，達到理論與實踐相結(jié)合的目的。
[Abstract]:Humanistic care is a theory born on the basis of humanism but higher than that of humanism. As the fundamental law of a country, the constitution actually concerns people by stipulating the operational rules of the country and regulating the state power. The mission of respecting human beings and providing a good platform for their development. Therefore, humanistic care is an inherent quality of the Constitution. Along with the development of the Constitution, this paper deeply analyzes the humanistic value and the essence of humanistic concern of the Constitution, which is the theoretical guarantee for our party and government to carry out their work. It is also a "sure pill" for strengthening the people's confidence in our party and our country. The Party's 18 National Congress has just been held, and it is precisely at a time when reform and development are showing an excellent situation of unlimited vitality, to maintain social stability. The realization of social harmony is an important prerequisite to guarantee the present good situation, and in practice, it is an indispensable force to protect the overall situation and promote harmony by putting the humanistic concern of the Constitution into practice. This paper first puts forward the origin of humanism and defines the humanistic concern which comes from its foundation, then explains the relationship between the humanistic concern of the constitution and the constitution, and uses English and French, The development of the constitutions of the three countries of the United States as an example, through the method of empirical analysis to interpret the connotation and characteristics of the humanistic care of the Constitution. Finally, to settle in China's actual situation, the author of the development of the Constitution of China, The existing problems and the ways to solve the problems put forward their own views to achieve the purpose of combining theory with practice.
