社會管理創(chuàng)新的憲法分析

【摘要】:社會經(jīng)濟的發(fā)展和進步需要轉變相應社會管理方式,以適應變化的社會需求。社會管理創(chuàng)新不僅是管理學概念,也是一個法學概念,其在憲法有深刻法理淵源。法學視野下的社會管理創(chuàng)新必須依法進行,不能超越憲法律規(guī)范,體現(xiàn)憲政內涵。當下快速發(fā)展轉型時期的中國,社會矛盾頻發(fā),在從具有數(shù)千年“人治”歷史轉向“法治”社會建設過程中,社會管理創(chuàng)新必須充分注重公民基本權利保障。保障公民基本權利即是社會管理創(chuàng)新內在要求,也是憲政核心價值追求。本選題通過案例分析和實證分析的研究方法,在分析我國轉型時期社會管理創(chuàng)新含義前提下,結合我國憲法司法實踐中案例,以保障公民基本權利為中心,提出在實踐中我國社會管理創(chuàng)新的法治訴求,論證其與我國憲政發(fā)展之間的關系,并針對我國社會管理創(chuàng)新中存在的問題并提出解決方法,以此推動我國憲政發(fā)展。 全文主體除去第一章緒論討論本選題研究價值、研究現(xiàn)狀研究方法和難點與創(chuàng)新點之外一共分為三部分,第二章分析我國社會管理現(xiàn)實運作方式,提出政府機關、司法機關和執(zhí)法機關在現(xiàn)階段社會管理中存在問題,并通過存在問題的分析進而說明我國現(xiàn)階段社會轉型時期社會矛盾頻發(fā)的背景下需要社會管理創(chuàng)新。第三章分析社會管理創(chuàng)新的內在機理,首先分析其憲法法理基礎,進而指出社會管理創(chuàng)新的法治訴求,并論證其與保障公民基本權利之間的關系,本章最后論述通過社會管理創(chuàng)新保障公民基本權利以推動我國憲政發(fā)展。第四章討論社會管理創(chuàng)新與憲法的實施,提出社會管理創(chuàng)新不能超越憲法法律規(guī)定,針對上文提出的我國社會管理現(xiàn)狀存在問題從黨的領導、政府機關、司法機關和執(zhí)法機關的角度提出解決方法。文章最后結語部分概括說明全文的寫作內容和寫作目的,希望本文能對我國社會管理創(chuàng)新和憲政的發(fā)展提供有益參考。
[Abstract]:The development and progress of social economy need to change the corresponding social management mode in order to adapt to the changing social demand. The innovation of social management is not only a concept of management, but also a concept of law. It has profound legal origin in the constitution. The innovation of social management under the vision of law must be carried out in accordance with the law, can not exceed the legal norms of the constitution, and embody the connotation of constitutionalism. In the current period of rapid development and transformation of China, social contradictions occur frequently. In the process of social construction from "rule by man" to "rule by law" for thousands of years, social management innovation must pay full attention to the guarantee of citizens' basic rights, which is the inherent requirement of social management innovation. It is also the pursuit of the core value of constitutionalism. Through the research methods of case analysis and empirical analysis, under the premise of analyzing the meaning of social management innovation in the transitional period of our country, this paper combines the case in the judicial practice of our country's constitution. Taking the protection of citizens' basic rights as the center, this paper puts forward the demand of rule of law for the innovation of social management in our country in practice, demonstrates the relationship between it and the development of constitutional government in our country, and puts forward some solutions to the problems existing in the innovation of social management in our country. In order to promote the constitutional development of our country. Apart from the introduction of the first chapter, the main body of this paper is divided into three parts, besides the research value, research methods, difficulties and innovation points. The second chapter analyzes the actual operation mode of social management in China, and puts forward the government organs. There are problems in the social management of the judiciary and law enforcement agencies at this stage. And through the analysis of the existing problems, it shows that social management innovation is needed under the background of frequent social contradictions in the current period of social transformation. The third chapter analyzes the internal mechanism of social management innovation, and firstly analyzes its constitutional legal basis. Furthermore, it points out the demand of the rule of law for the innovation of social management, and demonstrates the relationship between it and the protection of citizens' basic rights. Chapter 4th discusses the innovation of social management and the implementation of the Constitution, and points out that the innovation of social management cannot exceed the provisions of constitutional law. In view of the existing problems in China's social management mentioned above, from the perspective of the Party's leadership, government organs, judicial organs and law enforcement agencies, the author puts forward some solutions. The last part of the article summarizes the writing content and purpose of the full text. I hope this paper can provide a useful reference for the innovation of social management and the development of constitutionalism.
