【摘要】：特別行政區(qū)基本法作為憲法性法律,關(guān)系著憲法在特別行政區(qū)的穩(wěn)定實(shí)施和"一國(guó)兩制"的貫徹執(zhí)行,故最高權(quán)力機(jī)關(guān)對(duì)基本法進(jìn)行解釋是正當(dāng)、合法和必要的。為保證國(guó)家主權(quán)統(tǒng)一、促進(jìn)特區(qū)民主發(fā)展、維護(hù)特區(qū)繁榮穩(wěn)定并兼顧港澳過渡期后的法律制度銜接,結(jié)合全國(guó)人大常委會(huì)對(duì)香港基本法的四次釋法實(shí)踐,本文主張,全國(guó)人大常委會(huì)應(yīng)以"決定"的形式規(guī)范對(duì)特別行政區(qū)基本法的主動(dòng)解釋,并明確解釋的范圍和必要的法定程序。
[Abstract]:As a constitutional law, the basic Law of the Special Administrative region is related to the stable implementation of the Constitution in the Special Administrative region and the implementation of the principle of "one country, two systems". Therefore, it is legitimate for the supreme organ of power to interpret the basic law. In order to ensure the reunification of national sovereignty, promote the democratic development of the SAR, safeguard the prosperity and stability of the SAR, and take into account the convergence of the legal system after the transitional period between Hong Kong and Macao, and in combination with the four interpretations of the basic Law of Hong Kong by the standing Committee of the National people's Congress, This paper argues that the standing Committee of the National people's Congress should regulate the active interpretation of the basic Law of the Special Administrative region in the form of a "decision", and clearly define the scope of interpretation and the necessary legal procedures.
