【摘要】：住房權(quán)屬于社會(huì)權(quán)下的具體權(quán)利,其實(shí)現(xiàn)需要國際社會(huì)、國家和個(gè)人承擔(dān)不同的責(zé)任和義務(wù),然而三個(gè)層面的不同義務(wù)都存在著不同程度的問題與矛盾:國際層面,住房權(quán)實(shí)體性義務(wù)與程序性義務(wù)嚴(yán)重不平衡;國家層面,呈現(xiàn)美好理想狀態(tài)的一般義務(wù)與無奈現(xiàn)實(shí)之間進(jìn)行著博弈;個(gè)人層面,自我保障與政府阻礙之間不斷地拉鋸。這些問題與矛盾的存在,昭示著住房權(quán)的根本解決更多的是一種進(jìn)程,而不僅僅是一種建立起來的法律文本結(jié)構(gòu),其實(shí)現(xiàn)在理論上和實(shí)踐中都還有漫長的路要努力。
[Abstract]:The right to housing belongs to the specific right under the social right, its realization needs the international community, the state and the individual to bear the different responsibility and the duty. However, the three levels of different obligations have different degrees of problems and contradictions: at the international level, the substantial obligations of housing rights and procedural obligations are seriously unbalanced; At the national level, there is a game between the general obligation and the helpless reality. At the personal level, self-protection and government obstacles continue to draw a saw. The existence of these problems and contradictions shows that the fundamental solution of housing rights is more a process. In fact, there is still a long way to go in theory and practice.
