【摘要】：近些年,被精神病現(xiàn)象在我國不斷發(fā)生,已經(jīng)成為被精神病公民的人權(quán)遭受踐踏的法律事實(shí)；也成為普通公民“談虎色變”的熱點(diǎn)事件；同時(shí)更成為學(xué)術(shù)界關(guān)注的法律焦點(diǎn)之一。被精神病使人民生活在人人自危的恐懼之中；使人權(quán)被無情的踩在欲望、利益、權(quán)力之下；使原本最神圣的醫(yī)院給成為踐踏人民權(quán)利的“幫兇”；使法律變成了別有用心之人非法行為合法化的掩飾工具；使政府、法律的威信一次次受到挑戰(zhàn)。筆者選擇這個(gè)題目作為畢業(yè)論文的題目,是希望能夠起到拋磚引玉的效果,希望被精神病能夠在學(xué)界受到更廣泛的關(guān)注,希望國家能夠盡快出臺相關(guān)法律法規(guī)保護(hù)被精神病公民的合法權(quán)益。 本文一共分為六個(gè)部分。在緒論部分,筆者主要是通過案例引出被精神病這一法律事件。彭寶泉事件、徐林東事件是公權(quán)力介入被精神病事件的典型,是權(quán)力膨脹濫用的產(chǎn)物。鄒宜均事件是現(xiàn)代人在利益的驅(qū)使下人性扭曲的產(chǎn)物,使急需解救的現(xiàn)代人的人生觀、價(jià)值觀在利益面前毫無掩飾的暴露出來。喻家聲事件使我們認(rèn)真的思考單位的在公民生活中的地位以及權(quán)力問題。鐵一般的現(xiàn)實(shí)呈現(xiàn)在我們眼前,讓我們不得不去思考被精神病,所以第二部分主要講了三個(gè)內(nèi)容：被精神病的概念和特征、被精神病的原因以及被精神病所侵犯的公民權(quán)利。對此三個(gè)問題較為詳細(xì)的闡述,為論文研究的主要內(nèi)容打下良好的基礎(chǔ),同時(shí)也填補(bǔ)被精神病理論的部分空白。筆者通過分析我國現(xiàn)行法律對精神病問題的一些規(guī)定,呈現(xiàn)出現(xiàn)行法律的漏洞,是導(dǎo)致被精神病現(xiàn)象的屢屢發(fā)生的原因之一。例如,現(xiàn)行法律對強(qiáng)制收治概念的規(guī)定不能適應(yīng)快速發(fā)展的社會,與國際脫軌。另外,還有強(qiáng)制收治標(biāo)準(zhǔn)更是模糊不清,強(qiáng)制收治程序混亂等問題。通過研究國際公約及各國關(guān)于被精神病公民權(quán)利保護(hù)的立法,取之精華,去之糟粕,結(jié)合我國國情,應(yīng)用到我國實(shí)踐中去。例如,強(qiáng)制收治性質(zhì)的認(rèn)定、強(qiáng)制收治的認(rèn)定標(biāo)準(zhǔn)、收治程序以及救濟(jì)等都給筆者很大的啟發(fā),同時(shí)也值得我國立法者借鑒。筆者在最后提出了完善我國被精神病的公民權(quán)利保障的路徑通過分析強(qiáng)制收治的法學(xué)標(biāo)準(zhǔn)和醫(yī)學(xué)標(biāo)準(zhǔn),提煉出適合我國的強(qiáng)制收治標(biāo)準(zhǔn)；在規(guī)范強(qiáng)制收治程序上也提出了自己的見解,主要論述了對精神病患者的送治權(quán)、患者的知情同意權(quán)、出院權(quán),以及強(qiáng)制收治應(yīng)遵循司法鑒定程序等。同時(shí),筆者指出了對被精神病公民的救濟(jì)方法---建立監(jiān)督機(jī)制；保障當(dāng)事人的申訴、起訴的權(quán)利；建立合理的賠償制度。最后,是對相關(guān)人員處罰與制裁的研究。
[Abstract]:In recent years, the phenomenon of psychosis has occurred continuously in our country, which has become the legal fact that the human rights of psychotic citizens have been trampled on. It has also become a hot issue for ordinary citizens to "talk about tiger and change their colors"; At the same time, it has become one of the legal focuses of academic attention. Human rights are mercilessly trampled on desire, interest, power; (B) to make the most sacred hospitals "accomplices" in trampling on the rights of the people; The law has become a cover tool for the legalization of illegal acts by those with ulterior motives; So that the government, the credibility of the law has been challenged time and again. The author chose this topic as the title of the graduation thesis, I hope to play a role in attracting the effect of mental illness can be more widely concerned in the academic world. We hope that the state can introduce relevant laws and regulations as soon as possible to protect the legitimate rights and interests of citizens suffering from mental illness. This paper is divided into six parts. In the introduction part, the author mainly leads to the legal event of psychosis through cases. Peng Baoquan incident, Xu Lindong incident is a typical case of public power intervention by mental illness. Zou Yi-jun incident is the result of the distortion of human nature driven by the interests of modern people, which makes modern people in urgent need of rescue of their outlook on life. Values in front of the interests of undisguised exposure. Household voice events make us seriously consider the status of the unit in civil life and power. Iron reality in front of our eyes. So we have to think about being mentally ill, so the second part focuses on three parts: the concept and characteristics of psychosis. The causes of mental illness and the civil rights infringed by mental illness. The three questions are elaborated in detail, which lays a good foundation for the main contents of this paper. At the same time, it also fills up some gaps in the theory of mental illness. By analyzing some provisions of the current law on mental illness, the author presents the loopholes of the current law. For example, the current law on compulsory admission concept can not adapt to the rapid development of society, and international derailment. Through the study of international conventions and national legislation on the protection of the rights of citizens with mental illness, the essence is taken and the dross is removed. Combined with the situation of our country, it is applied to the practice of our country. For example, the identification of the nature of compulsory treatment, the standard of compulsory treatment, the procedure of treatment and the relief all give the author great inspiration. At the end of the paper, the author puts forward the way to perfect the civil rights protection of psychosis in our country by analyzing the legal standard and medical standard of compulsory treatment. To extract the compulsory admission standard suitable for our country; At the same time, it mainly discusses the right to be sent to mental patients, the right of informed consent, the right to discharge, and the compulsory treatment should follow the procedure of judicial expertise. At the same time. The author points out that the relief method to the citizens suffering from mental illness-- to establish a supervisory mechanism; Safeguarding the right of the parties to appeal and prosecute; To establish a reasonable compensation system. Finally, the study of the relevant personnel punishment and sanctions.
