【摘要】：公眾行政參與權(quán)作用和指向的對象是政府,有賴于相應(yīng)政府保障義務(wù)的履行方能實現(xiàn)。行政參與權(quán)的政府保障義務(wù)源于憲法、行政法兩個層面的原理和規(guī)范要求。憲法維度的政府保障義務(wù)立基于行政參與權(quán)的基本權(quán)利性質(zhì),行政法維度的政府保障義務(wù)則是行政參與權(quán)作為具體的行政法權(quán)利在公共行政中所對應(yīng)的行政主體義務(wù)。二者共同構(gòu)成行政參與權(quán)政府保障義務(wù)的整全框架。憲法維度的政府保障義務(wù)具有原則性和概括性,須透過行政法維度的政府保障義務(wù)予以具體化。根據(jù)行政參與權(quán)的實現(xiàn)邏輯,行政法維度的政府保障義務(wù)應(yīng)當(dāng)從公開行政、民主行政和責(zé)任行政三個層面具體展開。
[Abstract]:The role and direction of the public administrative participation right is the government, which depends on the corresponding government guarantee obligations to be fulfilled. The government guarantee obligation of the administrative participation right originates from the constitution. The principles and normative requirements of the two levels of administrative law. The constitutional dimension of government protection obligations based on the nature of the basic rights of administrative participation. On the other hand, the government guarantee obligation of administrative law dimension is the administrative subject obligation corresponding to the right of administrative law in public administration. Both of them constitute the whole framework of government safeguard obligation of administrative participation right. The obligation of government guarantee in the legal dimension is of principle and generality. According to the realization logic of administrative participation right, the government guarantee obligation of administrative law dimension should be from public administration. Three levels of democratic administration and responsible administration are carried out concretely.
