【摘要】：奧利弗·溫德爾·霍姆斯作為美國現(xiàn)代史和美國司法史的最著名的法官之一,在長達(dá)50年的法官生涯中,他的許多司法言論曾在美國法律界乃至全社會掀起了一個又一個思潮。他對于自由主義的追求幾乎貫穿了美國近代最高法院的歷史�；裟匪乖谒姆ü偕闹兴鶎懴碌呐袥Q意見最著名的部分集中在言論自由方面,時至今日依然被引用并編撰為集�！懊黠@而即刻的危險”原則是霍姆斯大法官在試圖找到言論自由限制與保護(hù)的努力和嘗試�！懊黠@而即刻的危險”原則的創(chuàng)立、發(fā)展及完善的過程,也反映了美國言論自由保障的發(fā)展軌跡。通過司法審查,“明顯而即刻的危險”原則很好地發(fā)揮了保障公民言論自由的作用。 本文結(jié)合聯(lián)邦最高法院的關(guān)于憲法第一修正案的經(jīng)典案例,以時代為背景系統(tǒng)地論述了“明顯而即刻的危險”原則的提出、發(fā)展與完善。比較在非常時期美國憲政下的言論自由與限制,梳理和展示在不同歷史時期對“明顯而即刻的危險”原則的適用。同時通過對霍姆斯本人的思想與生平的解讀,發(fā)掘霍姆斯本人在“明顯而即刻的危險”原則轉(zhuǎn)變過程中折射出的法學(xué)思想,進(jìn)而揭示體現(xiàn)在這一原則上的美國言論自由保障與限制的客觀規(guī)律與方法原理。
[Abstract]:Oliver Wendell Holmes, one of the most famous judges in the history of modern America and the history of American judicature, has been in another trend of thought in the American legal community and even the whole society in his 50 years of judge career. His pursuit of liberalism almost ran through the history of the modern Supreme Court of the United States. The most famous part of Holmes's judgment, written in his career as a judge, is focused on freedom of speech and is still quoted and compiled as a collection today. The "obvious and immediate danger" principle is the effort and attempt of judge Holmes to try to find the restriction and protection of freedom of speech. The process of the establishment, development and perfection of the principle of "obvious and immediate danger" also reflects the development track of the freedom of speech in the United States. Through judicial review, the principle of "obvious and immediate danger" has played a good role in guaranteeing the freedom of speech of citizens.
