【摘要】：在經(jīng)濟(jì)全球化的今天,在訴訟領(lǐng)域中電子郵件、手機(jī)短信、微信、QQ聊天記錄、電子簽名等借助于電子計(jì)算機(jī)或手機(jī)等電子設(shè)備作為其載體的電子數(shù)據(jù)已經(jīng)得到極大范圍的運(yùn)用,在一些案件中甚至起到了對(duì)審判定案至關(guān)重要的作用。但我國(guó)目前關(guān)于電子數(shù)據(jù)的相關(guān)立法是籠統(tǒng)而又零散的,還沒(méi)有形成完善的體系,致使審理民事案件時(shí)對(duì)電子數(shù)據(jù)認(rèn)證標(biāo)準(zhǔn)的不統(tǒng)一。采用電子數(shù)據(jù)作為案件審判依據(jù),要求其必須具有證據(jù)資格并且能夠?qū)ΥC事實(shí)達(dá)到一定的說(shuō)明程度。根據(jù)電子數(shù)據(jù)科技性及依賴(lài)性、形式多樣性、高度流轉(zhuǎn)性以及破壞性等特征,通過(guò)借鑒國(guó)外立法的證據(jù)認(rèn)證規(guī)則和佐證的方法,構(gòu)建適用于我國(guó)電子數(shù)據(jù)的非法證據(jù)排除規(guī)則,最佳證據(jù)規(guī)則,補(bǔ)強(qiáng)電子數(shù)據(jù)規(guī)則,證明力大小規(guī)則等以輔助電子數(shù)據(jù)證明能力及證明力在審判活動(dòng)中的認(rèn)證判斷。另外輔以向法庭提供電子數(shù)據(jù)的展示技術(shù)支持和日后電子數(shù)據(jù)相關(guān)立法出臺(tái)后向律師及民眾進(jìn)行電子數(shù)據(jù)收集提交的普法宣傳等配套措施。以期為進(jìn)一步解決電子數(shù)據(jù)在民事訴訟中的認(rèn)證問(wèn)題在理論上添磚加瓦。
[Abstract]:Today, with the globalization of the economy, e-mail, mobile phone messages, WeChat and QQ chat records in the field of litigation. Electronic signature and other electronic devices such as electronic computer or mobile phone as its carrier of electronic data has been widely used in some cases even played an important role in the final trial. However, the relevant legislation on electronic data in our country is general and fragmented, which has not formed a perfect system, which leads to the inconsistency of electronic data authentication standards in civil cases. The use of electronic data as the basis of case trial requires that it must have evidentiary qualifications and be able to treat the facts to a certain degree. According to the characteristics of electronic data, such as science and technology, dependence, variety of forms, highly fluid and destructive, the rule of illegal evidence exclusion applicable to electronic data in our country is constructed by drawing lessons from the evidence authentication rules of foreign legislation and the methods of corroboration. The best evidence rule, the reinforcing electronic data rule, the probative force rule and so on to assist the electronic data proof ability and the certification judgment in the trial activity. In addition to provide the court with electronic data display technical support and future electronic data-related legislation after the introduction of electronic data collection to lawyers and the public to submit electronic data dissemination and other supporting measures. In order to further solve the electronic data in civil litigation certification problem in theory.
