【摘要】：正審查起訴環(huán)節(jié)退回補(bǔ)充偵查是檢察機(jī)關(guān)刑事訴訟監(jiān)督的一項(xiàng)重要方式,是針對(duì)前期刑事偵查活動(dòng)可能存在漏洞和缺陷的一種補(bǔ)救性措施,其實(shí)質(zhì)是對(duì)前期刑事偵查活動(dòng)的補(bǔ)充和延續(xù),目的是彌補(bǔ)前期偵查活動(dòng)中案件事實(shí)、證據(jù)方面的缺陷和不足。然而,囿于諸多原因,審查起訴環(huán)節(jié)退回補(bǔ)充偵查(以下簡稱為"退查")在具體適用中卻存在
[Abstract]:It is an important way for procuratorial organs to supervise criminal proceedings by reviewing prosecution links and returning supplementary investigations, which is a remedial measure aimed at the possible loopholes and defects in criminal investigation activities in the early stage. Its essence is the supplement and continuation to the criminal investigation activity in the early stage, the purpose is to make up for the defect and deficiency in the facts and evidence of the case in the earlier investigation activity. However, due to many reasons, the review and prosecution link returned to the supplementary investigation (hereinafter referred to as "return investigation") exists in the specific application.
