【摘要】：神示證據(jù)制度追求神示真實(shí)、法定證據(jù)制度追求法定真實(shí)均不科學(xué)。自由心證證據(jù)制度追求心證真實(shí),并把心證真實(shí)視為證明標(biāo)準(zhǔn)也不科學(xué)。時(shí)代呼喚完全科學(xué)的新證據(jù)制度,這個(gè)歷史性的任務(wù)就落在中國(guó)肩上。新證據(jù)制度必須建立在辯證唯物主義的理論基礎(chǔ)之上。新證據(jù)制度的理論支柱是實(shí)質(zhì)證據(jù)觀、實(shí)質(zhì)真實(shí)觀、實(shí)質(zhì)真實(shí)標(biāo)準(zhǔn)。新證據(jù)制度的證據(jù)原則是實(shí)事求是原則、事實(shí)面前人人平等原則、證據(jù)效力全面統(tǒng)一原則、正確對(duì)待口供原則、忠實(shí)于事實(shí)真象原則。新證據(jù)制度的證據(jù)規(guī)則是證據(jù)排偽法則、證據(jù)蓋然性排除規(guī)則、論據(jù)規(guī)則、舉證規(guī)則、非法訊問(wèn)根除規(guī)則。新證據(jù)制度的名稱,根據(jù)歷代證據(jù)制度的命名規(guī)律,應(yīng)定為實(shí)質(zhì)真實(shí)證據(jù)制度。
[Abstract]:It is unscientific for the system of God evidence to pursue the truth of God and the system of legal evidence to pursue the legal truth. The system of free evidence pursues the truth of evidence, and it is not scientific to regard it as the standard of proof. The times call for a completely scientific new system of evidence, and this historic task falls on China's shoulders. The new evidence system must be based on the theory of dialectical materialism. The theoretical pillar of the new evidence system is the concept of substantial evidence and the standard of substantive truth. The principle of evidence in the new evidence system is the principle of seeking truth from facts, the principle of equality before facts, the principle of comprehensive unification of evidence effectiveness, the principle of correct treatment of confession, and the principle of being faithful to the principle of truth of facts. The rule of evidence in the new evidence system is the rule of eliminating false evidence, the rule of exclusion of evidence, the rule of argument, the rule of proof and the rule of eradication of illegal interrogation. The name of the new evidence system, according to the naming law of the evidence system in the past dynasties, should be regarded as the system of substantial and true evidence.
