【摘要】：英美對抗式的刑事審判模式一直是我國法律界著力引介、學習的對象,但各界對之的理解與認識卻或多或少地存在問題。美國學者蘭博約教授的《對抗式刑事審判的起源》揭示出,對抗式刑事審判的形成更多是各種主體在特定的歷史背景下對刑事審判合力作用的結果,而非理性建構的立法產物,歷史性的偶然因素在其中所起的作用不可忽視。蘭博約教授的研究及其很多觀點為我國當代刑事司法尤其是刑事審判制度的改革提供了有益的啟迪,從而值得我們高度重視。
[Abstract]:Anglo-American adversarial criminal trial mode has always been introduced and studied by the legal profession of our country, but the understanding and understanding of it have more or less problems. The Origin of adversarial Criminal trial by Professor Rambleau, an American scholar, reveals that the formation of adversarial criminal trial is more the result of the resultant effect of various subjects on criminal trial under the specific historical background, rather than the legislative product of rational construction. The role of historical accidental factors can not be ignored. Professor Ramboyo's research and many viewpoints have provided the beneficial enlightenment for our country's contemporary criminal judicature, especially the criminal trial system reform, therefore is worthy of our high attention.
