【摘要】：檢察引導(dǎo)偵查是近年來我國檢察機(jī)關(guān)在檢察制度改革中進(jìn)行的一項(xiàng)積極探索和有益嘗試，是檢察機(jī)關(guān)從實(shí)現(xiàn)控訴職能角度出發(fā)，通過介入偵查機(jī)關(guān)的偵查活動(dòng)，對(duì)偵查機(jī)關(guān)的偵查活動(dòng)提出意見、建議，引導(dǎo)偵查機(jī)關(guān)圍繞庭審要求，全面收集、固定證據(jù)的一種辦案模式。檢察引導(dǎo)偵查應(yīng)當(dāng)在現(xiàn)行法律框架內(nèi)進(jìn)行，其最終目的是為了提高偵查機(jī)關(guān)的辦案質(zhì)量，為控訴職能的實(shí)現(xiàn)提供強(qiáng)有力的支持，同時(shí)也是為了加強(qiáng)檢察機(jī)關(guān)對(duì)偵查活動(dòng)的法律監(jiān)督。本文簡要分析了檢察引導(dǎo)偵查的理論基礎(chǔ)，闡述了檢察引導(dǎo)偵查的必要性和可行性，，在此基礎(chǔ)上，就檢察引導(dǎo)偵查制度的具體構(gòu)建進(jìn)行了論證與探討。
[Abstract]:The procuratorial guidance investigation is a positive exploration and beneficial attempt in the procuratorial system reform of our country in recent years. It is that the procuratorial organ starts from the angle of realizing the prosecution function, through intervening in the investigation activity of the investigation organ. This paper puts forward some opinions on the investigation activities of the investigation organs, and suggests and guides the investigation organs to collect and fix the evidence in an all-round way around the court hearing requirements. Procuratorial guidance investigation should be carried out within the existing legal framework, the ultimate purpose of which is to improve the quality of the investigation organs' handling of cases, and to provide strong support for the realization of the prosecution function. At the same time, it is also to strengthen the procuratorial organs to the legal supervision of investigative activities. This paper briefly analyzes the theoretical basis of the procuratorial guidance investigation, expounds the necessity and feasibility of the procuratorial guidance investigation, and on this basis, discusses the concrete construction of the procuratorial guidance investigation system.
