【摘要】：本文就若干未成年人保護(hù)及犯罪預(yù)防問題進(jìn)行探討,支持現(xiàn)行法律規(guī)定,對當(dāng)前降低刑事責(zé)任年齡起點的呼聲予以質(zhì)疑。因性侵害犯罪具有隱秘性,故處理該類案件應(yīng)將未成年被害人陳述置于司法審查的核心地位。依據(jù)法理及對《刑事訴訟法》司法解釋若干條文的解析,可以認(rèn)為未成年人人身權(quán)的刑事附帶民事訴訟范圍包含死亡賠償金或殘疾賠償金,且受性侵害未成年人的心理康復(fù)治療費用應(yīng)獲判決支持。
[Abstract]:This paper probes into the protection of minors and the prevention of crimes, supports the existing laws and regulations, and questions the voice of lowering the age of criminal responsibility at present. Because of the secrecy of sexual assault crime, the underage victim's statement should be placed at the core of judicial review in dealing with this kind of case. According to the legal theory and the analysis of some articles in the judicial interpretation of the Criminal procedure Law, it can be concluded that the scope of the criminal incidental civil action for the personal rights of the minor includes the compensation for death or the compensation for disability. The cost of psychological rehabilitation should be supported by judgment.
