【摘要】：強(qiáng)迫-屈從型虛假自白屬于司法心理學(xué)的范疇,然而,本文更注重的是它與冤案錯(cuò)案的密切聯(lián)系�？萍硷w速發(fā)展下偵訊手段得以高度科技化的當(dāng)下也未能有效遏制國(guó)內(nèi)外冤案的頻發(fā),人們?nèi)栽谂φ覍て浒l(fā)生及其控防機(jī)制,如西方國(guó)家早早就致力于此項(xiàng)研究。然而國(guó)內(nèi)在此領(lǐng)域的研究才剛剛起步,同時(shí)伴隨著司法改革逐步由身體強(qiáng)制到心理強(qiáng)迫轉(zhuǎn)變的偵訊措施已然促發(fā)了大量的冤假錯(cuò)案,受到大眾的關(guān)注。理論與實(shí)踐脫節(jié)的當(dāng)下又有國(guó)際大環(huán)境中人權(quán)呼聲的趾高不下,要求我們國(guó)家必須致力于虛假自白的理論研究以同步于司法實(shí)踐的步伐,最大化的落實(shí)國(guó)家“依法治國(guó)”的理念。為此,筆者閱讀了許多的國(guó)內(nèi)外著作,并參閱參大量偵查訊問實(shí)例以及著名心理學(xué)試驗(yàn),在此基礎(chǔ)上本文將試圖完成能夠有效控制強(qiáng)迫-屈從型虛假自白的應(yīng)對(duì)策略的理論構(gòu)想。本文主要分為分為五個(gè)部分。第一部分為引言。第二部分對(duì)強(qiáng)迫-屈從型虛假自白做基本介紹。第三部分主要分析強(qiáng)迫-屈從型虛假自白的形成過程及產(chǎn)生原因。第四部分以呼格吉勒?qǐng)D案為例研究強(qiáng)迫-屈從型虛假自白的形成過程及產(chǎn)生原因。最后一個(gè)部分主要從偵查訊問中行為科學(xué)技術(shù)方法的應(yīng)用、偵訊制度的完善以及口供補(bǔ)強(qiáng)規(guī)則的構(gòu)建等三個(gè)方面為強(qiáng)迫-屈從型虛假自白的產(chǎn)生設(shè)置三道防線,以此盡可能杜絕冤案的頻發(fā)。
[Abstract]:Forced-subservient false confessions belong to the category of judicial psychology, however, this paper pays more attention to the close relationship between false confessions and wrongs. With the rapid development of science and technology, the investigation means can not effectively curb the frequent occurrence of domestic and foreign grievances, people are still trying to find its occurrence and control mechanism, such as the early commitment of Western countries to this research. However, the domestic research in this field has just started, and with the judicial reform gradually from physical compulsion to psychological compulsion of the investigation measures have promoted a large number of false cases, attracted public attention. At present, when the theory and practice are out of touch, there is a strong demand for human rights in the international environment, which requires our country to devote itself to the theoretical research of false confessions in order to synchronize with the pace of judicial practice. Maximize the implementation of the country's "rule of law" concept. For this reason, the author has read many books at home and abroad, and consulted a large number of investigative interrogation examples and famous psychological experiments. On this basis, this paper attempts to complete the theoretical conception of coping strategies that can effectively control forced-subservient false confessions. This paper is divided into five parts. The first part is the introduction. The second part introduces the forced-subservient false confessions. The third part mainly analyzes the forming process and causes of forced-subservient false confessions. The fourth part takes Huugjilt case as an example to study the forming process and causes of forced-submissive false confessions. The last part mainly sets up three lines of defense for the generation of force-subservient false confession from three aspects: the application of science and technology methods in investigation and interrogation, the perfection of investigation system and the construction of confession reinforcement rules. In order to eliminate as many wrongs as possible.
