【摘要】：十八屆四中全會(huì)后,行政公益訴訟問(wèn)題迅速成為輿論關(guān)注的熱點(diǎn)。學(xué)術(shù)爭(zhēng)議的焦點(diǎn)主要是制度構(gòu)建中可能面臨的問(wèn)題及解決方案,而必要性與可行性問(wèn)題則退居其次。當(dāng)前,試點(diǎn)工作啟動(dòng)在即,無(wú)論是相關(guān)的基礎(chǔ)理論,還是具體的程序制度、機(jī)制,都面臨著不少亟待解決的問(wèn)題。
[Abstract]:After the fourth Plenary session of the 18th CPC Central Committee, the issue of administrative public interest litigation has quickly become the focus of public opinion. The focus of academic controversy is the problems and solutions that may be faced in the system construction, while the necessity and feasibility problems take second place. At present, the pilot work is about to start, whether related basic theory, specific procedural system, mechanism, are facing a lot of problems to be solved.
