【摘要】：民事訴訟費用交納標準作為民事訴訟費用制度中的核心部分,同時也是民事訴訟制度順暢運作的重要保障。通過考察發(fā)現(xiàn),民事訴訟費用交納標準在實踐中存在交納標準混亂、交納標準單一、交納限度不定等問題。以上問題的存在影響了民事訴訟費用交納標準之基本功能的實現(xiàn),且與交納標準的設定原理相悖。因此,明確民事訴訟費用交納標準的設定原則,對其進行體系化、精細化、合理化設計,乃是完善民事訴訟費用交納標準的基本路徑。
[Abstract]:As the core part of the civil litigation cost system, the standard of paying the civil litigation expenses is also an important guarantee for the smooth operation of the civil litigation system. Through investigation, it is found that the standard of payment of civil litigation expenses is confused in practice, the standard of payment is single, the limit of payment is uncertain, and so on. The existence of these problems affects the realization of the basic function of the standard of payment of civil litigation expenses, which is contrary to the principle of setting the standard of payment. Therefore, it is the basic way to perfect the standard of payment of civil litigation expenses to make clear the principle of setting the standard of payment of civil litigation expenses, to systematize, refine and rationalize the design of the standard.
