【摘要】：訴訟管轄回避制度是維護(hù)程序正義、保障程序公正的重要訴訟機(jī)制,我國民事訴訟程序中尚未建立該項(xiàng)制度。隨著近幾年地方融資平臺的興起,地方政府建設(shè)性債務(wù)快速增長,融資平臺以其巨大的負(fù)債額和負(fù)債率、較低的營利能力和較弱的還款來源等因素,出現(xiàn)債務(wù)違約被起訴的風(fēng)險(xiǎn)正在上升。由于融資平臺涉貸案件債務(wù)人一方有地方政府背景的特殊身份因素,在法院審理過程中,代表債權(quán)人的一方當(dāng)事人有受到不公平對待的可能,在地方融資平臺違約訴訟中規(guī)定專門的管轄回避制度顯得尤為必要,以使與特殊地位當(dāng)事人具有特殊關(guān)系的法院可以回避管轄,從而在程序上保證融資平臺違約訴訟得到公平、公正地審理。
[Abstract]:The challenge system of litigation jurisdiction is an important litigation mechanism to safeguard procedural justice and guarantee procedural justice, which has not yet been established in the civil procedure of our country. With the rise of local financing platforms in recent years, the constructive debt of local governments has increased rapidly. The financing platform has many factors, such as its huge amount of debt and debt ratio, lower profitability and weaker repayment sources, and so on. The risk of debt default being prosecuted is rising. Because of the special identity factor that the debtor has local government background in the financing platform case, the party representing the creditor may be unfairly treated during the court proceedings. It is particularly necessary to stipulate a special jurisdiction and challenge system in the local financing platform breach litigation, so that the court with special relationship with the special status party can evade the jurisdiction, so as to guarantee the fairness of the financing platform breach litigation in the procedure. A fair trial.
