【摘要】：預(yù)審作為偵查階段證據(jù)核實(shí)的最后防線,也是起訴審判活動(dòng)的前置基礎(chǔ)。通過法條品讀及對既成學(xué)說的研究,可以推演出預(yù)審具備承續(xù)偵查、監(jiān)督保障和訴訟準(zhǔn)備三大應(yīng)然功能。而"偵審分設(shè)""偵審合一"等傳統(tǒng)預(yù)審模式在現(xiàn)實(shí)中亂象生成的癥結(jié),源自對預(yù)審功能體系的背離。為實(shí)現(xiàn)預(yù)審功能的本位回歸,因應(yīng)"以審判為中心"的改革基調(diào),祛離偵查本位的訴訟價(jià)值,破除"線性結(jié)構(gòu)"的訴訟構(gòu)造,需要預(yù)審重構(gòu)提供制度支撐。在"大刑偵"格局下布設(shè)預(yù)審框架,落實(shí)主辦責(zé)任制,輔以證據(jù)審核的重點(diǎn)移轉(zhuǎn)和專業(yè)人才的培育,以重構(gòu)與"以審判為中心"邏輯內(nèi)核相對接的預(yù)審模式。
[Abstract]:Pre-hearing is the last line of defense for the verification of evidence in the investigation stage, and it is also the basis of prosecution and trial. Through the reading of articles of law and the study of the established theory, it can be deduced that the prehearing has the following three functions: continuous investigation, supervision and protection, and lawsuit preparation. However, the traditional prehearing mode, such as "the division of investigation and trial" and "the unity of investigation and trial", is the crux of the confusion in reality, which originates from the deviation from the system of prehearing function. In order to realize the regression of prehearing function, according to the reform tone of "taking trial as the center", dispelling the litigation value of investigation standard and breaking the litigation structure of "linear structure", it is necessary to provide system support for pre-hearing reconstruction. Under the pattern of "Great Criminal investigation", the prehearing frame is set up, the responsibility system of the host is put into practice, the key point of evidence examination is transferred and the professional talents are cultivated, and the prehearing mode is connected with the logic core of "trial as the center".
