檢察機(jī)關(guān)提起環(huán)境行政公益訴訟問(wèn)題研究

【摘要】:近幾年,因行政機(jī)關(guān)的行政作為所引起的環(huán)境公益訴訟案件,產(chǎn)生了較大的社會(huì)影響。我國(guó)環(huán)境行政公益訴訟開展較晚,新修訂的《行政訴訟法》并未將其規(guī)定在內(nèi)。加之《環(huán)保法》雖確立了環(huán)境公益訴訟制度,但對(duì)原告的范圍作出限制。1黨的十八屆四中全會(huì)《決定》提出:探索建立檢察機(jī)關(guān)提起公益訴訟制度。為貫徹落實(shí)改革要求,最高檢發(fā)布了《檢察機(jī)關(guān)提起公益訴訟改革試點(diǎn)方案》(以下簡(jiǎn)稱:試點(diǎn)方案)。2作為新生事物,試點(diǎn)工作運(yùn)行時(shí)間較短且缺乏有益的經(jīng)驗(yàn),該制度仍存在著許多問(wèn)題亟待解決,如檢察機(jī)關(guān)職能定位問(wèn)題未作出解釋,存在主導(dǎo)訴訟的風(fēng)險(xiǎn)、受案范圍待擴(kuò)充、案件線索來(lái)源單一問(wèn)題,以及訴前程序中檢察建議的運(yùn)行未明確等問(wèn)題。本文首先研究了公益訴訟及行政公益訴訟的緣起,在此基礎(chǔ)上介紹了我國(guó)檢察機(jī)關(guān)提起環(huán)境行政公益訴訟的現(xiàn)狀、檢察機(jī)關(guān)提起環(huán)境行政公益訴訟的法理基礎(chǔ),提出環(huán)境行政公益訴訟理論研究不充分、檢察機(jī)關(guān)內(nèi)部自主性與外部協(xié)調(diào)性不強(qiáng)、環(huán)境行政公益訴訟配套措施不健全等問(wèn)題。在結(jié)合檢察機(jī)關(guān)法律監(jiān)督職責(zé)基礎(chǔ)上,就檢察機(jī)關(guān)提起環(huán)境行政公益訴訟的職能定位與法律依據(jù)、如何完善檢察機(jī)關(guān)內(nèi)部與外部協(xié)調(diào)關(guān)系以及相關(guān)配套制度等方面進(jìn)行探討,希望通過(guò)本次研究對(duì)我國(guó)檢察機(jī)關(guān)提起環(huán)境行政公益訴訟作出一定的貢獻(xiàn)。
[Abstract]:In recent years, environmental public interest litigation cases caused by the administration of administrative organs have had a great social impact. The Environmental Administrative Public interest Litigation in China is late, but the newly revised Administrative Litigation Law does not include it. In addition, although the Environmental Protection Law establishes the system of environmental public interest litigation, it limits the scope of plaintiff. The fourth Plenary session of the 18th CPC Central Committee, "decision", puts forward: to explore the establishment of public interest litigation system by procuratorial organs. In order to implement the reform requirements, the Supreme Procuratorate issued the "pilot Program for the Reform of Public interest Litigation initiated by the Procuratorial organs" (hereinafter referred to as the pilot Program) .2 as a new thing, the pilot work runs for a short time and lacks useful experience. There are still many problems to be solved in this system, such as the unexplained function orientation of procuratorial organs, the risk of leading litigation, the expansion of the scope of cases, and the single source of case clues. And the operation of procuratorial suggestion in the procedure before lawsuit is not clear and so on. This paper first studies the origin of public interest litigation and administrative public interest litigation, and on this basis introduces the current situation of environmental administrative public interest litigation initiated by procuratorial organs in China, and the legal basis of environmental administrative public interest litigation initiated by procuratorial organs. The author points out that the theory of environmental administrative public interest litigation is not enough, the internal autonomy and external coordination of procuratorial organs are not strong, and the supporting measures of environmental administrative public welfare litigation are not perfect. On the basis of the legal supervision duties of procuratorial organs, this paper probes into the functional orientation and legal basis of the procuratorial organs in bringing environmental administrative public interest litigation, how to perfect the internal and external coordination relations between procuratorial organs and related supporting systems, and so on. Through this study, the author hopes to make some contributions to the environmental administrative public interest litigation filed by the procuratorial organs in China.
