【摘要】：惡意訴訟是用合法手段掩蓋非法目的的侵權(quán)行為。它是指當(dāng)事人借由提起訴訟或通過訴訟程序，在明知自己的行為違背法律及社會(huì)誠信、無事實(shí)根據(jù)或正當(dāng)理由的情況下，故意侵害國家，集體和他人的合法權(quán)益的侵權(quán)行為。2012年新民訴法并沒有將全部的惡意訴訟行為類型納入法條的規(guī)制范圍，在制度上也缺乏與相關(guān)法律的配合，不能夠形成規(guī)制惡意訴訟行為的合力。因此，，我國對惡意訴訟的規(guī)制要還需要進(jìn)一步完善，“實(shí)體法與程序法并重”，以保障公民的合法權(quán)益，促使我國民事訴訟體制不斷地優(yōu)化。
[Abstract]:Malicious litigation is a tort that uses legal means to cover up the illegal purpose. It refers to the intentional infringement of a country by a party who, by reason or through legal proceedings, knows that his actions are contrary to the law and social good faith, without any factual basis or justification, The new civil action law of 2012 did not bring all the malicious action types into the regulation scope of the law, and also lacked the cooperation with the relevant laws in the system. Can not form the joint force of the regulation of malicious litigation. Therefore, the regulation of malicious litigation in our country should be further improved, "substantive law and procedural law should be paid equal attention to" in order to protect the legitimate rights and interests of citizens and promote the continuous optimization of our civil litigation system.
