【摘要】：證明妨礙是訴訟中普遍存在的現(xiàn)象，卻沒有得到重視。證明妨礙的形式隨著時間推移多種多樣且日趨復雜化，若不進行規(guī)制，會造成當事人之間的利益受損且不利于實現(xiàn)訴訟的公平和正義，而我國民事訴訟法和司法解釋關于證明妨礙行為的規(guī)定存在諸多不足，因此，完善法律和司法解釋對證明妨礙的規(guī)定，，建立完善的證明妨礙制度成為理論和實踐中急需解決的問題。本文首先論述了證明妨礙的概念，在厘清概念之后進一步分析證明妨礙行為的構成要件和法理基礎，形成對證明妨礙行為初步了解。其次，論述先進國家和地區(qū)的證明妨礙制度，為我國建立證明妨礙制度提供參考意見。再次，剖析我國證明妨礙行為的規(guī)制現(xiàn)狀以及存在的不足，在歸納總結當前對證明妨礙制度的法律適用效果之后，針對所存在的缺陷，提出完善我國證明妨礙制度的建議，以及與其相適應的配套制度，共同規(guī)制證明妨礙行為。
[Abstract]:Proof that obstruction is a common phenomenon in litigation has not been taken seriously. The forms of proof hindrance are various and complex over time. If not regulated, the interests of the parties will be damaged and the fairness and justice of the litigation will not be realized. However, there are many deficiencies in the provisions of our civil procedure law and judicial interpretation on the proof of obstruction. Therefore, it is necessary to perfect the provisions of the law and judicial interpretation on the obstruction of proof. The establishment of perfect proof hindrance system has become an urgent problem in theory and practice. This paper first discusses the concept of proof hindrance, after clarifying the concept, further analyzes the constitutive elements and legal basis of proof obstruction behavior, and forms a preliminary understanding of proof obstruction behavior. Secondly, the paper discusses the system of proof hindrance in advanced countries and regions, and provides reference for establishing proof hindrance system in our country. Thirdly, it analyzes the current situation and shortcomings of the regulation of proof hindrance in our country. After summing up the legal application effect of the proof hindrance system at present, it puts forward some suggestions to perfect the proof hindrance system in our country in view of the defects. And the corresponding supporting system, together with the regulation of proof of obstruction behavior.
