【摘要】：少年司法制度發(fā)展,大致可分為五個(gè)階段。少年司法制度在其發(fā)展過(guò)程中,基本上是搖擺于向刑事司法方向還是向福利方向發(fā)展之間。通過(guò)總結(jié)和對(duì)比,我國(guó)的少年司法制度還存在沒(méi)有獨(dú)立的審理少年違法犯罪的程序法、還沒(méi)有將未成年人犯罪問(wèn)題作為與成年人犯罪存在著本質(zhì)上不同的問(wèn)題來(lái)加以對(duì)待和處理等問(wèn)題。對(duì)此,應(yīng)通過(guò)修改刑法并在條件成熟時(shí)再制定《少年刑法》等法規(guī)和措施來(lái)加以完善。
[Abstract]:The juvenile justice system can be divided into five stages . In the course of its development , the juvenile justice system basically vacates between the direction of criminal justice and the development of welfare direction . Through summing up and comparing , the juvenile justice system of our country still has no independent procedural law to deal with juvenile delinquency .
