【摘要】：當(dāng)前司法改革進(jìn)程中對于司法責(zé)任制的完善,重要內(nèi)容包括法官獎勵與懲戒兩方面制度建設(shè)。法官獎懲制度的建構(gòu),其前提和基礎(chǔ)是理解法官的制度定位,從而明確對其實(shí)施獎懲的制度邏輯。從規(guī)范文本與司法實(shí)踐中所進(jìn)行的分析,可以發(fā)現(xiàn)我國法官獎懲制度中有多重邏輯的并存,科層制的邏輯在其中發(fā)揮著更為突出的作用。需要基于中國現(xiàn)實(shí)與司法規(guī)律,以自洽的邏輯來指引法官獎懲制度,從而完善司法責(zé)任制。
[Abstract]:In the process of judicial reform, the important contents of judicial responsibility system include the system construction of judges' reward and punishment. The premise and foundation of the construction of the system of judges' rewards and punishments is to understand the positioning of the judges' system and thus to make clear the system logic of the rewards and punishments. From the analysis of the normative text and judicial practice, it can be found that there are many kinds of logic in the system of judges' rewards and punishments in our country, in which the logic of the hierarchy system plays a more prominent role. In order to perfect the judicial responsibility system, it is necessary to guide the system of judges' rewards and punishments with self-consistent logic based on the Chinese reality and judicial law.
