論高校懲戒學(xué)生行為的司法審查

【摘要】:高校懲戒學(xué)生行為是高校運(yùn)用懲戒權(quán)對(duì)學(xué)生實(shí)施的一種責(zé)難性措施,高校懲戒權(quán)是從屬于高校管理權(quán)的一項(xiàng)公權(quán)力。長(zhǎng)期以來(lái),我國(guó)高校在學(xué)生管理方面占據(jù)著主導(dǎo)地位,其充分運(yùn)用高校管理權(quán)為學(xué)校治理和學(xué)生管理發(fā)揮了積極作用。但同時(shí),高校在行使管理權(quán)的過(guò)程中經(jīng)常忽視對(duì)學(xué)生權(quán)利的尊重和保護(hù),尤其在高校對(duì)學(xué)生實(shí)施懲戒行為的過(guò)程中。一方面,自田勇訴北京科技大學(xué)案被法院受理后,學(xué)術(shù)界對(duì)法院能否介入高校管理行為展開(kāi)了激烈的討論;另一方面,隨著我國(guó)高等教育的快速發(fā)展,學(xué)生狀告學(xué)校的案件頻頻發(fā)生,這其中因高校懲戒學(xué)生行為而引發(fā)的訴訟占據(jù)相當(dāng)比例,實(shí)務(wù)界,法院對(duì)此類案件的不同處理方式,對(duì)同類案件采用不同審查標(biāo)準(zhǔn),運(yùn)用不同審查依據(jù)造成類似案件卻有不同審判結(jié)果,嚴(yán)重影響了法律的穩(wěn)定性和可預(yù)期性。因此,明確高校行政主體地位,厘清高校懲戒學(xué)生行為與司法審查的關(guān)系,統(tǒng)一高校懲戒學(xué)生行為司法審查的受案范圍、審查標(biāo)準(zhǔn)和審查依據(jù)成為目前急需解決的問(wèn)題。 本文首先對(duì)高校懲戒學(xué)生行為司法審查的含義進(jìn)行分析,厘清高校懲戒權(quán)、高校懲戒學(xué)生行為、高校懲戒學(xué)生行為司法審查三者之間的關(guān)系,并闡述了高校懲戒學(xué)生行為司法審查與大學(xué)自治的關(guān)系。其次,在高校懲戒學(xué)生行為現(xiàn)有救濟(jì)制度缺陷的基礎(chǔ)上結(jié)合國(guó)內(nèi)外理論與實(shí)踐對(duì)高校懲戒學(xué)生行為納入司法審查的必要性和可行性進(jìn)行理論與實(shí)證分析。最后,根據(jù)引起懲戒原因的性質(zhì)不同,將高校懲戒學(xué)生行為司法審查區(qū)分為基于紀(jì)律性和基于學(xué)術(shù)性兩種原因引起的司法審查,并對(duì)各類司法審查的受案范圍、審查標(biāo)準(zhǔn)和審查依據(jù),在結(jié)合國(guó)外相關(guān)理論和實(shí)務(wù)的基礎(chǔ)上進(jìn)行比較研究。受案范圍上采用重要性標(biāo)準(zhǔn),僅限于高校懲戒行為對(duì)學(xué)生受教育權(quán)和接受教育完整性造成影響的案件;審查標(biāo)準(zhǔn)上,紀(jì)律性懲戒行為采取嚴(yán)格的形式審查和實(shí)質(zhì)審查,而學(xué)術(shù)性懲戒行為最大限度的尊重學(xué)校懲戒決定,只進(jìn)行適度審查;審查依據(jù)上,兩種懲戒行為司法審查均依據(jù)法律法規(guī),參照規(guī)章,但由于高校擁有學(xué)術(shù)自主權(quán),學(xué)術(shù)性懲戒行為司法審查不能輕易排除內(nèi)部規(guī)范的適用,而紀(jì)律性懲戒行為只需嚴(yán)格依據(jù)法律法規(guī)即可。
[Abstract]:The behavior of disciplinary students in colleges and universities is a kind of censure measure that colleges and universities carry out to students by using disciplinary power. The disciplinary power of colleges and universities is a public power subordinate to the management power of colleges and universities. For a long time, colleges and universities in China have played a leading role in student management, and their full use of university management power has played an active role in school governance and student management. But at the same time, colleges and universities often ignore the respect and protection of students' rights in the process of exercising their management power, especially in the process of carrying out disciplinary actions against students in colleges and universities. On the one hand, since the case of Tian Yong v. Beijing University of Science and Technology was accepted by the court, the academic circles have launched a heated discussion on whether the court can intervene in the management of colleges and universities; on the other hand, with the rapid development of higher education in China, The cases of students suing the school occur frequently, among which the litigation caused by the disciplinary actions of students in colleges and universities occupies a considerable proportion. In the practical circles, different ways of handling such cases are adopted by the courts, and different censorship standards are adopted for the similar cases. The application of different examination bases leads to different trial results in similar cases, which seriously affects the stability and predictability of the law. Therefore, it is urgent to clarify the status of administrative subject, clarify the relationship between disciplinary students' behavior and judicial review, unify the scope of the judicial review of disciplinary students' behavior in colleges and universities, and examine the standard and basis of the review. Firstly, this paper analyzes the meaning of judicial review of disciplinary behavior of college students, and clarifies the relationship between the right of discipline and the judicial review of behavior of disciplinary students in colleges and universities. And elaborated the university discipline student behavior judicial review and the university autonomy relations. Secondly, the necessity and feasibility of bringing disciplinary behavior into judicial review are analyzed theoretically and empirically on the basis of the defects of the existing remedy system of disciplinary students' behavior in colleges and universities, combined with the theory and practice at home and abroad. Finally, according to the nature of disciplinary reasons, the judicial review of disciplinary behavior of college students is divided into judicial review based on discipline and academic reasons, and the scope of cases of all kinds of judicial review. Based on the relevant theories and practices of foreign countries, the comparative study is carried out on the basis of the standards and the basis of the review. In the scope of accepting a case, the importance standard is adopted, which is limited to the cases in which the disciplinary behavior of a university has an impact on the students' right to receive education and the integrity of the education; on the other hand, the disciplinary conduct is strictly examined in form and in substance. The academic disciplinary behavior should respect the decision of the school discipline to the maximum extent, and only carry on the appropriate examination. On the basis of the examination, the judicial review of the two kinds of disciplinary conduct is based on the laws and regulations, but the academic autonomy of the university is due to the fact that the institution of higher learning has academic autonomy. The judicial review of academic disciplinary behavior can not easily exclude the application of internal norms, but discipline can only be strictly based on laws and regulations.
