【摘要】：網(wǎng)絡(luò)司法拍賣是互聯(lián)網(wǎng)時代一種新型的司法強(qiáng)制拍賣形式,具有合法性。我國雖然對網(wǎng)絡(luò)司法拍賣制度進(jìn)行了規(guī)定,但仍存在一定問題。本文通過對德國、韓國、法國等國家對網(wǎng)絡(luò)司法拍賣規(guī)定的研究,以期借鑒其中適合我國國情的成功經(jīng)驗(yàn),對我國網(wǎng)絡(luò)司法拍賣制度進(jìn)行構(gòu)建。具體措施包括健全法律體系、規(guī)范運(yùn)行機(jī)制、提高監(jiān)督能力和設(shè)置權(quán)利救濟(jì)制度,以更有效地促進(jìn)民事執(zhí)行的實(shí)現(xiàn)。
[Abstract]:Network judicial auction is a new type of judicial compulsory auction in the Internet era, which has legitimacy. Although our country has carried on the stipulation to the network judicial auction system, but still has certain problems. Through the research on the regulations of internet judicial auction in Germany, South Korea, France and other countries, this paper hopes to draw lessons from the successful experience which is suitable for our country's national conditions, and to construct the network judicial auction system of our country. The concrete measures include perfecting the legal system, standardizing the operating mechanism, improving the supervision ability and setting up the right relief system, so as to promote the realization of civil execution more effectively.
