【摘要】：隱匿身份偵查指的是偵查人員或受委托偵查的人員隱匿其真實身份實施的偵查。各國立法與實踐,都概括性地認可了隱匿身份偵查所獲取的證據(jù)的證據(jù)能力。但是,沒有經(jīng)過授權(quán)的隱匿身份偵查,其所獲得證據(jù),形同違法取得的證據(jù),沒有證據(jù)能力,這是絕對證據(jù)排除法則。對恣意授權(quán)、逾越授權(quán)和口頭授權(quán)則必須區(qū)分對待。隱匿身份偵查秘密性與其他訴訟規(guī)則存在沖突與調(diào)和。隱匿身份偵查的偵查人員或受委托人員一般具有證人資格。國外司法對隱匿身份偵查所獲得的物證、書證等證據(jù)都持較為寬松的態(tài)度。隱匿身份偵查人員獲取的被害人陳述一般不應(yīng)具有證據(jù)資格。隱匿身份偵查人員獲取的犯罪嫌疑人口供的證據(jù)能力主要考慮兩個因素:身份偽裝是否對自由意志具有強制性;隱匿身份偵查的具體手段是否對自由意志具有強制性。
[Abstract]:The investigation of concealing identity refers to the investigation carried out by investigators or entrusted investigators who conceal their real identity. The legislation and practice of various countries have generally recognized the evidence ability obtained by the investigation of concealing identity. However, without authorization to conceal identity, the evidence obtained is similar to illegal evidence, and there is no evidence capacity, which is the absolute rule of evidence exclusion. A distinction must be made between arbitrary, transgressive and verbal authorizations. There are conflicts and conciliations between secret investigation and other procedural rules. Investigators or authorized persons who conceal their identity generally have the qualification of witnesses. The foreign judicature holds a more lenient attitude towards the material evidence, documentary evidence and other evidence obtained in the investigation of concealing identity. Generally speaking, the victim statement obtained by the investigators should not be qualified as evidence. There are two main factors in the evidence ability of the criminal suspect's confession obtained by the secret investigator: whether the identity camouflage is mandatory to the free will and whether the specific means of concealing the identity investigation have the compulsion to the free will.
